We request under the California Public Records Act (CPRA) the following 30 distinct items, in 5 parts, from each Supervisor, the Clerk of the Board, and County Counsel:

A. an electronic copy, with all headers, metadata, timestamps, attachments, appendices, exhibits, and inline images, except those explicitly exempted by the CPRA, of the most recent 10 emails RECEIVED BY the OFFICIAL government email account of
1. the District 1 Supervisor
2. the District 2 Supervisor
3. the District 3 Supervisor
4. the District 4 Supervisor
5. the District 5 Supervisor
6. the Clerk of the Board
7. the Counsel to the Board

B. an electronic copy, with all headers, metadata, timestamps, attachments, appendices, exhibits, and inline images, except those explicitly exempted by the CPRA, of the most recent 10 emails SENT FROM the OFFICIAL government email account of
1. the District 1 Supervisor
2. the District 2 Supervisor
3. the District 3 Supervisor
4. the District 4 Supervisor
5. the District 5 Supervisor
6. the Clerk of the Board
7. the Counsel to the Board

C. an electronic copy, with all headers, metadata, timestamps, attachments, appendices, exhibits, and inline images, except those explicitly exempted by the CPRA of the most recent 10 emails SENT FROM the PERSONAL email account(s) of the following officials, TO/CC/BCC any buttecounty.net email address, SOLELY to the extent that such emails are regarding the public's business and public records under relevant statute and case law, including but not limited to City of San Jose v Superior Court (2017). If NO such emails exist for each request, remember you must state under Govt Code 6253(c) that there are no responsive records.
1. the District 1 Supervisor
2. the District 2 Supervisor
3. the District 3 Supervisor
4. the District 4 Supervisor
5. the District 5 Supervisor
6. the Clerk of the Board
7. the Counsel to the Board

D. an electronic copy, with all headers, metadata, timestamps, attachments, appendices, exhibits, and inline images, except those explicitly exempted by the CPRA of the most recent 10 emails RECEIVED BY the PERSONAL email account(s) of the following officials, FROM any buttecounty.net email address, SOLELY to the extent that such emails are regarding the public's business and public records under relevant statute and case law, including but not limited to City of San Jose v Superior Court (2017). If NO such emails exist for each request, remember you must state under Govt Code 6253(c) that there are no responsive records.
1. the District 1 Supervisor
2. the District 2 Supervisor
3. the District 3 Supervisor
4. the District 4 Supervisor
5. the District 5 Supervisor
6. the Clerk of the Board
7. the Counsel to the Board

Furthermore: If your response to any of C1-7 or D1-D7 is "no responsive records," I would also like:
E1. the affidavit, response, confirmation or any other message/record by the individual official stating that they have no such public records on their personal account, if they provide any such response under the County's policies for searching personal accounts for public records, and also
E2. the instrument used by the County to inquire into the public records that may be present on the officials' personal accounts, if any

You are of course welcome to redact any solely personal identifiers of the official (personal email addresses, home/phone/etc.). Anything you do not redact will be visible on MuckRock.com

Please do not include spam or draft emails. "Most recent N emails" means: For received messages, the top N messages, sorting in descending order by time received, received no later than June 4, 2019; For sent messages, the top N messages, sorting in descending order by time sent, sent no later than June 4, 2019. This is usually the default sort order in someone's folders for most email systems.

We remind you of your obligations to provide electronic records in the original format you hold them in. PDFs are fine as long as you include non-exempt headers/metadata (From/To/Sent/Received/Bcc/Cc/attachments/inline images, etc.).

Under the CPRA, you should provide a response to each of the 30 requests indicating no responsive records, that you have provided all responsive records, that you have withheld all responsive records, or that you have disclosed in part and withheld in part responsive records. Withholding requires justification.

Please provide only those copies of records available without any fees. If you determine certain records would require fees, please instead provide the required notice of which of those records are available and non-exempt for inspection in-person if we so choose.

Sincerely,
Anonymous

In response to your request for public records reproduced below, please find (attached) records that are responsive to your request. Some records have been withheld or redacted on the basis that they constitute attorney-client privileged communication or attorney work product (Gov’t’ Code § 6254(k), Code Civ. Proc. § 2018.030, Evid. Code § 954); for reasons of personal privacy (Cal. Const. art. I, sec. I, Govt. Code § 6255); or because they are exempt from disclosure under the deliberative process privilege (Cal. Govt. Code § 6255(a), Times Mirror Company v. Superior Court of Sacramento County (1991) 53 Cal.3d 1325).
The attached records constitute a partial production. We anticipate producing additional records on a rolling basis, with the next production occurring on or before July 12, 2019.

Please contact me if you have any questions.

Further to my email below, attached are additional records responsive to your request. This batch of records has redactions to protect personal privacy, (Cal. Const. art. I, sec. I, Cal. Govt. Code § 6255); on the ground that the redacted portions are exempt from disclosure under the deliberative process privilege (Cal. Govt. Code § 6255(a), Times Mirror Company v. Superior Court of Sacramento County (1991) 53 Cal.3d 1325); or on the ground that the public interest served by not disclosing sensitive information in the record clearly outweighs the public interest served by disclosure of that information (Cal. Govt. Code § 6255).

Our review of records is ongoing, and we anticipate producing additional records on a rolling basis, with the next production occurring on or before July 19, 2019.

Please contact me if you have any questions.
