RE: Zoo Records - Immediate Disclosure Request (SF Parks and Rec)

San Francisco Recreation and Park Department, Recreation and Park Commission, and Joint Zoo Committee:

Below are Immediate Disclosure Requests (SF Admin Code 67.25(a)) directed to San Francisco Recreation and Park Department, Recreation and Park Commission, and Joint Zoo Committee. Your response is required by Jan 28, 2020. Rolling records responses are requested (SFAC 67.25(d)) if you are unable to immediately produce records. Exact copies (not URLs) of every responsive record are requested (Gov Code 6253(b)) - do not or print and scan electronic records or provide black and white versions of any color record - use full-fidelity PDFs. Provide only copies of records not requiring fees and in-person inspection of all other records (GC 6253).

Your non-exhaustive obligations: All withholding of any information must be justified (SFAC 67.27). All withholdings by masking or deletion (aka redactions) must be keyed by footnote or other clear reference to justification and only the minimal exempt portion of a record may be withheld (SFAC 67.26). Respond to emailed requests (SFAC 67.21(b)). You must notify us of whether or not responsive records exist and/or were withheld for each below request (Gov Code 6253(c), 6255(b)). You must state the name and title of each person responsible for withholding any information (Gov Code 6253(d)). You must do all of this in your response, and you cannot wait until we file complaints.

****** We have no duty to, and we will not again, remind the City of its obligations. Instead, we will file complaints for every Sunshine Ordinance or CPRA violation. We will continue to file complaints until your procedures are modified to fully comply with the Sunshine Ordinance and CPRA, without caveat or exception. ******

1. all contracts/agreements/MoUs of any kind currently in effect including all appendices, exhibits, attachments, memos, amendments where any party is San Francisco Zoological Society
2. all communications with the San Francisco Zoological Society, its officers, employees, or agents between Oct 1, 2019 and present
3. all "transactions" between Oct 1, 2019 and present of the San Francisco Zoological Society disclosable (defined and pursuant to SFAC 67.29-7(c))
4. all records of the health of City-owned animals at the Zoo, sent, received, or created between Oct 1, 2019 and present

Personal accounts pursuant to City of San Jose must also be searched.

NOTE: Please be certain you have properly redacted all of your responses. Once you send them to us, there is no going back. The email address sending this request is a publicly- viewable mailbox. All of your responses (including all responsive records) may be instantly and automatically available to the public online via the MuckRock.com FOIA service used to issue this request (though the requester is an anonymous user, not a representative of MuckRock). Nothing herein is legal, IT, or professional advice of any kind. The author disclaims all warranties, express or implied, including but not limited to all warranties of merchantability or fitness. In no event shall the author be liable for any special, direct, indirect, consequential, or any other damages whatsoever. The digital signature, if any, in this email is not an indication of a binding agreement or offer; it merely authenticates the sender. Please do not include any confidential information, as I intend that these communications with the City all be disclosable public records.

Dear Anonymous,

My apologies, I was not in the office yesterday, so this was received today. In the future, please send sunshine requests to rpdinfo@sfgov.org<mailto:rpdinfo@sfgov.org> as that account is more regularly monitored. We see you labeled your request as an immediate disclosure request. However, the immediate disclosure process is reserved for requests that are normal or routine or readily answerable, rather than requests so extensive as this. Since this is not a proper immediate disclosure request, we will instead treat it as a regular request. Therefore we will provide a response within 10 days, by February 7.

Please let me know if you have any questions.

Good morning,

Our department will endeavor to identify and compile documents responsive to your request, quoted below:

"1. all contracts/agreements/MoUs of any kind currently in effect including all appendices, exhibits, attachments, memos, amendments where any party is San Francisco Zoological Society
2. all communications with the San Francisco Zoological Society, its officers, employees, or agents between Oct 1, 2019 and present
3. all "transactions" between Oct 1, 2019 and present of the San Francisco Zoological Society disclosable (defined and pursuant to SFAC 67.29-7(c))
4. all records of the health of City-owned animals at the Zoo, sent, received, or created between Oct 1, 2019 and present"

Regarding #2 of your request:
Your request is so broad that there are potentially thousands of responsive records, all of which would need to be reviewed and potentially redacted to protect private information of individuals contacting the department. To facilitate a prompt reply, we suggest you limit your request to a more limited scope (i.e. a particular user, or between specific parties, specific subject titles)
Please let us know how you would like to proceed.

Best,

Tiffany Lin-Wilson
Secretary

I do not waive my right to any public records previously requested.

However, if you are able to produce a list of From, Subject, and Date for the items in #2, I can be more specific in which emails I'd like full copies.
