Pursuant to Mayor London Breed's Proclamation dated March 13, Sections 67.25(a) and 67.25(b) of the Administrative Code are suspended for the duration of the local emergency. 

For this reason, we are treating your Immediate Disclosure Request as a standard public records request, subject to the normally applicable 10-day response time, with a possible extension.

Our department will identify and compile the requested information. The Sunshine Ordinance requires departments to respond as soon as possible or within 10 calendar days from receipt of any records requests. Therefore, we will contact you on or before July 27, as permitted by San Francisco Administrative Code § 67.21(b) and California Government Code § 6253(c). Please note that the Public Records Act requires an agency to make available to any person a copy of an "identifiable record or records" in its possession, unless the record is specifically exempt from disclosure. (Please see California Government Code § 6253(b).) The City's obligation under the Sunshine Ordinance, like the Public Records Act, is to produce public records in its custody. (See San Francisco Administration Code § 67.20(b).) There is no requirement that a department or officer construct a document to meet the specifications of the request.

We will produce responsive records online through the NextRequest portal. However, if hard copies are needed, we can provide hard copies of any 8.5x11 documents that are made available to you at a cost of 10 cents per copy, as allowed by the San Francisco Administrative Code § 67.28(c). This section states "a fee not to exceed 10 cents per page may be charged." Postage is an additional cost.

In lieu of hard copies, we can burn the responsive records onto a CD at a rate of $1 per CD or load the responsive records onto a flash drive at a rate of $4 per flash drive. Fees for duplication are subject to change and postage is an additional cost.

Let me re-request #1 as new #3:

Please produce the "derek smith.txt-redacted.pdf" email in either PDFMaker OR the same form in which DPW previously produced the following prior email record (if these forms are different): https://cdn.muckrock.com/foia_files/2020/12/10/FW_2020MANDATORY20NOTIFICATION_20Public20Records20Request202320-4788.pdf

The metadata of that PDF indicates you produced it using PDFMaker. Thus PDFMaker is available to your department, and I can request it under Admin Code 67.21(L). I will be precise about this in future requests for email.

PDFMaker won't give me the headers but it does preserve essentially every other part of the email (most importantly the formatting), which is why I prefer it when asking for exact (non-metadata) copies of emails in PDF form. The vast majority of persons who don't perform technical analysis on records (and myself, in most cases) would get everything they want via PDFMaker. I want to be able to see the record as close as possible to whatever the city sees - which includes formatting, emphasis, indentation, attachments, etc.

The problem is that you (i.e. the City, I don't know who does what) have also removed the hyperlink to Alaric's email address which is NOT exempt. That was the problem with how your coworker did the emails in 19097 and the basis for the non-metadata violations in that case.

You need to talk to your IT staff about the correct redaction settings. One setting removes ALL interactive content like hyperlinks (email addresses are embedded as hyperlinks in the PDF, as it happens) but another setting allows you to just remove the hyperlinks (email addresses) that you want to redact. I've attached a correct example from the Library Commission. Notice how SOLELY the email addresses that they wanted to exempt cannot be clicked on as hyperlinks.

RE 21-1027:

1. Regardless of whether you decide to narrow-by-agreement below, please also provide as a separate request all communications with IT on doing the full and Nuru/Degrafinried searches for request 21-1027, any IT tickets or search history showing the searches performed, and any query and results or similar that IT has showing exactly how this number was determined and searches were performed. (not for the narrower search that hasn't happened yet, but for the prior 2 searches).

2. Narrowing subject to conditions

If DPW first agrees to the Conditions below, then you may narrow the scope of 21-1027 as follows:
- Nuru records from June 1, 2017 to present
- Degrafinried records from June 1, 2017 to present
- all non-email records I requested for Nuru and Degrafinried

Conditions:
Provide a signed letter addressed to "Anonymous (arecordsrequestor@protonmail.com)" agreeing that:
DPW shall preserve, and shall cause its employees to preserve (including on their personal property), all records that existed as of the date of receipt of the original request 21-1027 that are responsive to the original full scope of request 21-1027 from requests@muckrock.com for at least one year after the later of (i) the date the letter is signed and (ii) the final adjudication of all complaints, appeals, or petitions for request 21-1027.

Attach to the letter a copy of the email issued by DPW to employees to preserve the records, and a copy of the original full scope request received from me. (As you know, I or anyone else may still request these full-scope-preserved records or subsets thereof in other requests).

This letter would be signed by Alaric Degrafinried or a managerial employee authorized to do so (such as you, if you are authorized AND are a manager) and must bind DPW. A managerial city employee is required because if DPW violates the agreement I intend to pursue that violation as official misconduct under Admin Code 67.34.

21-1027 - As you wish: My request as originally stated stands. As you know, the City can't destroy records once they have been requested, until the final adjudication of all appeals. So whether you sign something or not, preservation remains required.

You can give rolling responses for the request starting with {June 2017 to original date of request for Nuru/Degrafinried emails + un-limited Nuru/Degrafinried non-emails}. If I cannot prioritize the rolling response this way, I will simply file a separate request for that limited scope.

I will later request your request to employees for their personal records as well to ensure that your passing on of my request to DPW staff meets the full requirements of City of San Jose v Superior Court. Remember that work related to the conduct of public business, not only City business, is included. These are not the same things when say a federal investigation is involved (which is still public business, if not City business). I have previously prevailed when agencies fail to give all records on personal property about public business (see SOTF 19098 v SFPD, where SFPD was found to violate 67.21(k) because they asked employees to search ONLY if they used their personal accounts for business. Sometimes ppl have records about the conduct of public business even if they did not intentionally use their personal accounts this way, and that was in fact the case with SFPD as we later determined and they accepted.).

City of National City).

Also, to confirm your last remark: the entire DPW lacks "texts, chats, or instant messages" with Paul Guisti? Or just Nuru/Degrafinried?

It is not possible, however, for us to complete your request by today’s deadline. Please note that during the current public health emergency, the department is not required to provide copies of records within 10 days, plus a possible 14-day extension, but must notify the requester whether the records exist.  We will continue searching, reviewing and redacting records, and will produce responsive records as soon as reasonably possible. We estimate that we will be able to produce the records approximately June 30.
