From: Shawn Musgrave
To Whom It May Concern:
Pursuant to the California Public Records Act, I hereby request the following records:
All search warrant applications (including affidavits), search warrant returns, after-action reports, incident reports, and all other documents concerning the raid on Bryan Carmody's home.
This is a resubmission of a prior request. In the interim since I last submitted this request, judges have unsealed the search warrant applications and affidavits, and SFPD has issued a number of public statements about the investigation. As such, SFPD has a far less plausible assertion of investigative privileges against disclosing the requested records.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter.
I look forward to receiving your response to this request within 10 calendar days, as the statute requires.
Sincerely,
Shawn Musgrave

RE: Public Records Request, dated August 27, 2019, Reference # P008819-082719
Dear Shawn Musgrave:
The San Francisco Police Department (SFPD) received your Public Records Act request, dated August 27, 2019, on September 04, 2019.
You requested, " To Whom It May Concern:"
The SFPD is not the custodian of record for the Search Warrant, Affidavits, Returns, etc. You will need to contact the Clerk of the Court as the SF Superior Court is the custodian of record. Each of the judges involved in the search warrant process has processed the warrants that he/she signed.
Note: plaintiffs' attorneys have been provided with redacted copies of the search warrant documents and have released some documents to local SF news media. If you difficulty navigating the SF Courts, you may wish to reach out to either Mr. Carmody's attorney or counsel for The First Amendment Coalition.
The initial death investigation report of Mr. Adachi has been uploaded to the GovQA portal for your convenience.
I am awaiting an update on the status of the remaining investigations.
Thank you for your attention.
Sincerely,
Michael Andraychak

All search warrant applications (including affidavits), search warrant returns, after-action reports, incident reports, and all other documents concerning the raid on Bryan Carmody's home.
This is a resubmission of a prior request. In the interim since I last submitted this request, judges have unsealed the search warrant applications and affidavits, and SFPD has issued a number of public statements about the investigation. Generally, SFPD declines to release records to an open investigation under California Government Code Section 6254(f), which exempts from disclosure records of complaints to, investigations conducted by, intelligence information or security procedures of, and investigatory or security files compiled by local police agencies. There remains an open investigation regarding Mr. Carmody.
As such, we are unable to provide you with the information you seek, as disclosure of information may endanger successful completion of the investigation.
If you have any questions, please contact Michael Andraychak at 415-837-7395.
Thank you for your attention.
Sincerely,
Sergeant Michael Andraychak
Officer in Charge
