Pursuant to the California Public Records Act (California Government Code §§ 6250), I hereby request the following records:

All planning emails, presentations, and correspondence regarding sidewalk trash cans during 2015 and 2016. All letters, emails, and complaints received by residents about sidewalk trash cans during 2015 and 2016.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

The documents will be used in the process of reporting for Motherboard, VICE’s science and tech site (www.motherboard.vice.com).

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request and I request that this be processed in the "media" fee category. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am acknowledging receipt, but before we can accept and begin work on this request we need to work with you to clarify your request items.

You requested:

1. All planning emails, presentations, and correspondence regarding sidewalk trash cans during 2015 and 2016

2. All letters, emails, and complaints received by residents about sidewalk trash cans during 2015 and 2016.

For both items: We would like to clarify what you mean by “sidewalk trash cans.” Are you referring to the publicly owned City trash cans or black, blue and green bins that residents place on the sidewalk for pickup by the garbage company?

For item number 1: We would like your assistance in narrowing this request. As it is currently phrased, this request is overly broad and unduly burdensome. Please know that the we have the ability to search e-mails if the following information is
provided: (1) name of person; (2) time period; and (3) search terms. The term “sidewalk trash cans,” is unspecific. Searching all staff emails for those terms would likely return tens of thousands of emails which would then need to be reviewed for sensitive information such as the contact information of members of the public. I would be happy to discuss this request with you and help you narrow it. Feel free to call me at 415-554-6972. As a member of the press, you can also call our Communications Director, Rachel Gordon at 415-554-6045. She can help you get information and provide comment for any potential stories.

For item number 2: Please see above and clarify what you mean by “sidewalk trash cans.” We receive complaints regarding both types and would like to confirm which ones you are interested in before moving forward with this request.

Please note that the Public Records Act requires an agency to make available to any person a copy of an “identifiable record or records” in its possession, unless the record is specifically exempt from disclosure. (Please see California Government Code § 6253(b).) The City’s obligation under the Sunshine Ordinance, like the Public Records Act, is to produce public records in its custody. (See San Francisco Administration Code § 67.20(b).) There is no requirement that a department or officer construct a document to meet the specifications of the request.
