Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

All documents, recordings, video, witness statements, interviews, driver statements, results of drug testing, and anything else related to the investigation of the vehicle accident on August 11, 2012 at Eddy and Larkin which resulted in the death of Edmund Capalla..

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

I am writing to acknowledge your request for Police Department public records, received at the Media Relations Unit via email on 10/29/12.
Your request has been denied. 6454(f) of the Government Code protects Investigatory Files and are exepmt from disclosure. In addition, the exemption for investigatory files does not terminate with the conclusion of the investigation.
Furthermore, California Vehicle Code section 20012 protects traffic collision reports and may only be disclosed to parties involved (drivers, drivers representatives, parent/guardian, persons injured, owner of vehicle/property damaged, attorney or persons who may incur civil liability).
