To Whom It May Concern:

Pursuant to the California Public Records Act, I hereby request the following records:

Copies of emails sent to, from, or through the High Tech Crime Consortium ListServ. The emails may be identified by having one or more of the following:

* A sender with a display name of either "High Tech Crime Consortium Listserv" or "High Tech Crime Consortium"
* A subject containing either "HTCC" or "[HTCC]"
* Sent to or from an email address containing "htcc" or hightechcrimecops.org

You may limit this request to records generated between April 1, 1998 and the date of the processing of this request.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Emma Best

Dear Ms. Best,

This is in response to your August 10, 2020 public records request, in which you requested:
“Copies of emails sent to, from, or through the High Tech Crime Consortium ListServ. The emails may be identified by having one or more of the following:
* A sender with a display name of either "High Tech Crime Consortium Listserv" or "High Tech Crime Consortium"
* A subject containing either "HTCC" or "[HTCC]"
* Sent to or from an email address containing "htcc" or hightechcrimecops.org”
For records between April 1, 1998 and August 10, 2020.

Processing your request requires searching for, collecting, and examining a voluminous amount of possibly responsive and non-privileged records. Additionally, there may be a need to consult with other agencies on some of the records discovered.

In addition, we cite Mayor London Breed’s March 30, 2020 Temporary Modification of Public Records Law During COVID-19 Local Emergency for additional time to respond in light of the pandemic. Our estimate is that we will respond within ten additional days, but this may change. We but we will keep you informed and encourage you to check in.

Thank you,

SF DA Public Records

From: San Francisco District Attorney's office

Thank you for following-up. Your request has generated a voluminous amount of possibly responsive and non-privileged records. If you could tailor your request to a specific email or phrase used, we would be able to get you documents more quickly. Additionally, we need to consult with other agencies on some of the records discovered. Otherwise, we will continue to review the documents collected and will send you records on a rolling basis once we have consulted with other agencies.
Thank you.
Sincerely,
SFDA Public Records

From: Emma North-Best

A rolling basis is fine, but please keep in mind that those other agencies already shared the information with people who are not part of law enforcement or any government body, as well as foreign nationals and government agencies, per the HTCC website. This obviously affects the status and releasability of the information.
