You made a 2nd reply to this complaint originating from here. That reply states:
"Anonymous may, as an alternative, submit a request to SFPUC for records defined by subject matter – for example, records pertaining to the SFPUC’s Community Benefits and/or Social Impact Partnership Program.” Unlike auditor files which may not be disclosed under State law, SFPUC’s records regarding the Community Benefits/Social Impact Partnership Program are public records generally subject to disclosure, except to the extent particular records or parts of records might be subject to applicable exemptions. Accordingly, Anonymous is free to submit a public records request targeted to that subject matter."

Those are your words.

Therefore, this is a new request (which does not replace any others, nor does it moot any complaint against you) for: "records pertaining to the SFPUC’s Community Benefits and/or Social Impact Partnership Program". There are no limitations whatsoever by date or person. Provide rolling responses and exact copies of all records.

You cannot now limit my ability to make this request, due to vagueness, overbroadness, or any other reason. YOU suggested the request, stated I was "free to submit a public records request targeted to that subject matter," and I will most certainly take advantage of the opportunity. If you deny the request, that is yet another misrepresentation by PUC.

We write in response to your request dated May 17 in which you asked for all “records pertaining to the SFPUC’s Community Benefits and/or Social Impact Partnership Program,” with “no limitations whatsoever by date or person.”

We agree that records pertaining to the SFPUC’s Community Benefits and/or Social Impact Partnership Program are public records that are not subject to a blanket exemption like the audit records that were the subject of your prior request.

The Community Benefits Program was developed in response to the Community Benefits Policy adopted by the Commission in 2011. The Commission-adopted Community Benefits Policy is attached. The Social Impact Partnership Program (previously referred to as the Community Benefits in Contracts Program), also launched in 2011, is a program whereby the SFPUC invites private sector firms who work on SFPUC projects to embody the Commission-adopted Community Benefits Policy and be a good neighbor to the communities impacted by SFPUC’s capital projects and service operations. As part of the solicitation process for certain SFPUC contracts, firms responding to Request for Proposals (RFPs) are able to pledge Social Impact Partnership commitments to local, impacted communities.

Based on your request, it appears you’re interested in documents related to the Social Impact Partnership Program. If you are interested in documents related to this program, we are happy to provide you with documents related to it. However, the Community Benefits and Social Impact Partnership Programs were created in 2011, ten years ago. The Social Impact Partnership Program alone involves 84 separate SFPUC contracts, and multiple different SFPUC staff over the years have worked on these. In addition to the Social Impact Partnership Program, there are staff and programs, such as our education programs teaching SFUSD public school students about water and clean power, that operationalize the Community Benefits Policy. Searching through ten years’ worth of all records pertaining to these programs would garner thousands of records that will take years to review. Your request as currently phrased is unreasonably burdensome.

In the spirit of being as transparent as possible, and responsive to the core of your request, please find attached detailed documents related to the Social Impact Partnership Program. Hopefully this is responsive to the core of what you’re looking for. If you are looking for something more specific, we ask you to please target your request more narrowly for example by timeframe, particular employee(s), a particular contract of interest, or by some other method. We would be happy to talk with you to describe the types/categories of records we have related to the CB and/or SIP Program and how these programs work in order to assist you in refining your request in a manner that is more likely to yield the types of records you are seeking and that we would be able to produce to you in a reasonable amount of time.
