Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

Copies of the "Equitable Sharing Agreement and Certification" forms submitted for the years 2009-2013 to the Department of Justice. The DOJ requires any law enforcement agency that participates in its equitable sharing program for asset forfeiture proceeds to submit these forms on an annual basis.

I request that all fees be waived first and foremost because I am a journalist -- employed by MuckRock and the Boston Globe -- and intend to use any pertinent information I receive as a result of this request to educate the public on the DOJ's equitable sharing program.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Thank you very much for your help with this, and the prompt response. Looking through the documents more closely, it appears that the form for FY2009 doesn't actually include the equitable sharing information for that year. According to the FY 2009 form, SFPD started FY 2010 with more than $1 million in Justice Funds and more than $200,000 in Treasury Funds. But the FY 2009 form says SFPD received no equitable sharing proceeds that year, did not start with any Justice or Treasury funds, and did not end with any Justice or Treasury funds.

Is that the correct version of the FY 2009 form?
