SFMTA, and its employees, including Mr. Maguire, must respond to requests sent by email (67.21(b)).

From: San Francisco Municipal Transportation Agency

Attached please find documents responsive to items 1 - 5 of your request. Please note the following:

Exemptions and Privileges

The SFMTA is not required to disclose records where disclosure of such records would constitute an unwarranted invasion of personal privacy. (California Constitution, Article I, §1; Cal. Gov't Code § 6254(c); see also Cal. Gov't §6254(k); Hill v. National Collegiate Athletic Assn., (1994) 7 Cal. 4th 1, 35 (identifying privacy interest in precluding dissemination of sensitive, confidential information); Teamsters Local 856 v. Priceless, LLC, (2003) 112 Cal. App. 4th 1500, 1512 (public employees have right of privacy in their personnel files); Braun v. City of Taft, (1984) 154 Cal.App.3d 332, 345-347); City of San Jose v. Superior Court, (1999) 74 Cal.App.4th 1008 (court denied media's request for names and contact information of complainants).) Because disclosure of some of the documents responsive to your request, are personnel records, containing information confidential under both the California Constitution and Section 6254(c) of the Public Records Act, we have redacted portions of some of the documents that we are disclosing for this reason.

Also, it is the policy of the SFMTA to release all documents in PDF.
SFMTA staff is continuing to locate and review additional responsive non-privileged documents and will provide those documents to you on a rolling basis. S.F. Admin. Code §67.25(d).

Thanks Ms. Leger. We will maintain complaint 19133.
Ms. Celaya did not confirm whether or not Mr. Maguire (not her) received my emailed requests. All SFMTA employees, including Mr. Maguire, must respond to requests sent by email (67.21(b)).

From: San Francisco Municipal Transportation Agency

I’ve confirmed that Tom Maguire did receive the request but did not see it because it was automatically sent to his spam folder.
To avoid this happening in the future, please send email requests to me or to sfmtasunshinerequests@sfmta.com<mailto:sfmtasunshinerequests@sfmta.com> .

SOTF FILE 19133

MTA - Thank you. Please submit an amended response to SOTF, for my complaint to avoid misleading the SOTF. In the future I'd suggest checking every location of records requests before you represent to the SOTF that a complainant is wrong or that you did not get a request.
We shall file further complaints on the deficiencies of your substantiative response as well.

SOTF - we shall continue all complaints against MTA. The MTA Dept Head did in fact receive my original requests but did not read them.

NOTE: Please be certain you have properly redacted all of your responses. Once you send them to us, there is no going back. The email address sending this request is a publicly- viewable mailbox. All of your responses (including all responsive records) may be instantly and automatically available to the public online via the MuckRock.com FOIA service used to issue this request and various services that mirror those documents for analysis and research by journalists and the general public (though the requester is an anonymous user, not a representative of MuckRock). Dear SOTF:

The SFMTA would like to amend our initial response to this complaint.

We have recently learned that this request was received and located in Tom Maguire's spam folder.

Please note that upon receiving the request via my email 12/23, we did promptly reply with responsive records, first batch on 12/24 and second on 12/31.

To avoid similar delays we have advised the requestor that it is best to send requests via our online portal https://sfmta.mycusthelp.com/WEBAPP/_rs/(S(gfwjga2co0dk0gqconreqixu))/supporthome.aspx, our sfmtasunshinerequests@sfmta.com<mailto:sfmtasunshinerequests@sfmta.com> or directly to me.

Please let me know if you have additional questions or concerns.

RE: SOTF FILE 19133 - for addition to the file

To MTA: Thank you Ms. Celaya. As is our standard practice, we are happy to, in exchange for a specific letter signed by your department head discussing how MTA will improve its records procedures, dismiss this case. If you would like to discuss the details of such a negotiated dismissal, please let me know. Otherwise, we shall continue to seek all violations and orders in this case. (We reserve our right to file further complaints or appeals about the content as opposed to timeliness of your response as well.)

To SOTF: Given the Respondents' amended response, the SOTF should take as proven the sole alleged 67.21/67.25 violation in Case 19133 - Respondents failed to respond in a timely or complete manner to an immediate disclosure request. The Dec. 7 Saturday IDR was deemed received Monday Dec. 9. Initial response was due Dec 10. First actual response was actually Dec. 24.

Note that Celaya indicates this is timely with respect to *her* receipt, not Maguire's receipt, of my request. However, Respondent Maguire is and was independently required by law to respond to emailed requests (SFAC 67.21(c)) as held repeatedly by SOTF pursuant to *his* receipt of the request. We take no position on whether Maguire must personally respond or his delegate Celaya may respond on his behalf (which appears to be a long-pending issue before SOTF), but the clock runs as to the receipt by anyone in MTA of a records request.

As a general aside, this case is yet another example why electronic metadata is so important in public records. I could prove who knew what when using email metadata.

NOTE: Please be certain you have properly redacted all of your responses. Once you send them to us, there is no going back. The email address sending this request is a publicly- viewable mailbox. Dear Anonymous, Filed via MuckRock.com:
The SFMTA is in receipt of your email, dated January 9, 2020, in which you offer to withdraw your pending complaint with the Sunshine Ordinance Task Force in exchange for a discussion of how the SFMTA will improve our records procedures.

As to the SFMTA’s existing procedures, the agency has in place a robust, online public-records system designed to timely receive, log, respond to, and document the over 1,000 requests received each year. This system has been in place for three years and is the fastest and most efficient way to confirm receipt of your request as well as provide responsive documents to your request. The link to this system is: https://sfmta.mycusthelp.com/WEBAPP/_rs/(S(spsg1zgf5bih0ydj1mlq4pgy))/supporthome.aspx

Note that how spam is determined is proprietary information. All city departments use Microsoft technology. Neither Microsoft nor Barracuda, an additional technology the SFMTA uses, make that information public.

To ensure timely receipt and response to any future requests, we urge you to please use this system. If you cannot access this system, however, we ask that you transmit your requests directly to me, at caroline.celaya@sfmta.com<mailto:caroline.celaya@sfmta.com>. And, should you elect to transmit your requests to other employees at the agency, note that we have whitelisted the domain @muckrock.com which, will allow all emails from that domain to bypass spam and go directly to employees’ email.

Please let me know if you any questions or if I can be of further assistance with this matter.
Sincerely,

Caroline Celaya

Excellent - Thank you. Please issue me that signed by your department head (ex. a PDF), and 19133 will be dismissed.

(To avoid doubt, we cannot dismiss SOTF 19133 until the letter above is signed by Tom Maguire and that letter is published to us. )

From: Anonymous Journalist

It appears that you do not wish to issue such letter. Therefore, we shall proceed to hearing to ask SOTF to find all violations and issue all orders.

From: San Francisco Municipal Transportation Agency

We are not required to create a record in response to a request.

From: Anonymous Journalist

Of course you do not have to create any records. But you also cannot violate any Sunshine Ordinance requirements, which you did. Departments have two options: they can wait to be ordered into compliance by the SOTF or they can do so voluntarily.

You have made your choice.

RE: BCC Emails - Immediate Disclosure Request

Department Head:

Below are new Immediate Disclosure Requests (SF Admin Code 67.25(a)) directed to your agency and the department head. Your response is required by Feb 11, 2020. Rolling records responses are requested (SFAC 67.25(d)) if you are unable to immediately produce records. Exact copies of every responsive record are requested (Gov Code 6253(b)) - do not: provide mere URLs, print and scan electronic records, convert native files to PDFs, or provide black and white versions of any color record. Provide only copies of records not requiring fees and in-person inspection of all other records (GC 6253). Emails are requested in the easily-generated EML or MSG formats (SFAC 67.21(l)).

I am now auditing how the City appears to unlawfully withhold the BCC recipients of emails when they print out emails in certain formats. The identity of BCC recipients is not exempt. BCC is not an information security record that reveals vulnerabilities or increases chance of an attack. The BCC names was typed in by a human being and are not metadata. You must provide BCC just like you provide To or CC recipients. There is no legal authority to keep secret the identities of persons communicating with government officials, unless they are specifically confidential informants and such. If you withhold the BCC names, I will file complaints, separate and apart from email metadata complaints (which I have now already won, see ruling in SOTF 19044).

Your non-exhaustive obligations: All withholding of any information must be justified in writing (SFAC 67.27). All withholdings by masking or deletion (aka redactions) must be keyed by footnote or other clear reference to the specific justification for that redaction, and only the minimal exempt portion of any record may be withheld (SFAC 67.26). You must respond to emailed requests (SFAC 67.21(b)). You must notify us of whether or not responsive records exist and/or were withheld for each below request (Gov Code 6253(c), 6255(b)). You must state the name and title of each person responsible for withholding any information (Gov Code 6253(d)). Do not impose any end-user restrictions upon me (Santa Clara Co. vs Superior Ct, 170 Cal.App 4th 1301); so if you use a third-party website to publish records, please make them completely public without any login or sign-in.

Your agency must do all of the above things in your response, and you cannot wait until we file complaints.

****** We have no duty to, and we will not again, remind the City of its obligations. Instead, we will file complaints for every Sunshine Ordinance or CPRA violation. We will continue to file complaints until the City's procedures are modified to fully comply with the Sunshine Ordinance and CPRA, without caveat or exception. ******

1. An exact copy with all email headers (incl. but not limited to the BCC identities), attachments, color, formatting and all other parts of the record of the most recent 5 emails which have any BCC recipients which were sent by your Dept Head on any government account . Note that you will have to search directly from the person's computer or account in their Sent folder specifically (In many email systems, no other method will allow you to see the BCC recipients). In modern Outlook systems, the search query is as follows: (bcc:*)

Do not destroy or discard any responsive records - we will appeal all withholdings or Sunshine violations.

NOTE: Please be certain you have properly redacted all of your responses. Once you send them to us, there is no going back. The email address sending this request is a publicly- viewable mailbox. All of your responses (including all responsive records) may be instantly and automatically available to the public online via the MuckRock.com FOIA service used to issue this request (though the requester is an anonymous user, not a representative of MuckRock). Nothing herein is legal, IT, or professional advice of any kind. The author disclaims all warranties, express or implied, including but not limited to all warranties of merchantability or fitness. In no event shall the author be liable for any special, direct, indirect, consequential, or any other damages whatsoever. The digital signature, if any, in this email is not an indication of a binding agreement or offer; it merely authenticates the sender. Please do not include any confidential information, as I intend that these communications with the City all be disclosable public records.

Sincerely,

Anonymous
