To Whom It May Concern:

** NOTE: Please redact all responses correctly! This is a public mailbox, and all of your responses (including disclosed records) may be automatically and instantly available to the general public on the MuckRock.com service used to issue this request (though I am not a MuckRock representative). Once you send them to us, there is no going back. **

We request under the San Francisco Sunshine Ordinance (Ordinance) and the California Public Records Act (CPRA) the attached items from the Office of the Mayor . Part A and B are an immediate disclosure request, the rest are regular timeline.

Sincerely,
Anonymous

From: Office of the Mayor

Dear Anonymous,

We received this request in the Office of the Mayor on September 11, 2019 and are processing our response.

Your request purports to be an immediate disclosure request but fails the requirement of seeking material that is simple and routine to provide. Moreover, your request necessitates consultation with another department. Accordingly, the Office of the Mayor will treat this request as subject to the full 10 day period to respond for a regular request and reserves its rights to seek a further extension as needed. See Admin Code 67.25; Government Code § 6253(c).

Please let us know if you have questions regarding your request.
Regards,

Hank Heckel
Compliance Officer
Office of Mayor London N. Breed

From: Office of the Mayor

Dear Anonymous,

We are continuing to process your attached request and are providing herewith responsive records located to date.

Please note that certain personal information such as private email and residential addresses have been redacted to avoid an unwarranted breach of personal privacy. See Cal. Govt. Code Secs. 6254(c), 6254(k); California Constitution, Art. I, Sec. 1.

The responsive information has been provided in a PDF format for its ease of transferability and accessibility, consistent with Cal. Gov. Code 6253.9(a)(1). Metadata from any native format has not been provided to avoid risks to the security and integrity of the original record as well as the city's data and information technology systems and to avoid the release of exempt confidential or privileged information. See Cal. Gov. Code 6253.9 (f) and 6254.19. The PDF format ensures the security and integrity of the original record as well as the security and integrity of the city's data and information technology systems.

Please also note that we are invoking an extension of up to 14 days to continue our response pursuant to Government Code § 6253(c) and San Francisco Admin. Code § 67.25(b) because of the need for consultation with another city department.

Your request also appears overly broad in that it seeks all documents from essentially all Mayoral staff for nearly 9 months containing the terms "Adachi" or "public defender". These terms encompasses potentially a wide range of documents that do not relate to the subject matter in which you are interested. For example, documents with that term from the period prior to Jeff Adachi's death could relate to routine administrative and budget matters relating to the Office of the Public Defender that do not relate to the investigation you reference in the balance of your request.

Please consider excluding the terms "Public Defender" and "Adachi" from your request so that we may focus our efforts and yours on the documents in which you are interested.

Please also note that we are responding on behalf of the Office of the Mayor only and not on behalf of other City Departments. If you have questions about your request or would like to make another public records request please let us know.
Regards,

Hank Heckel
Compliance Officer
Office of Mayor London N. Breed

Thank you.

As you probably expect, I continue to object to all exclusion of headers/metadata (including, but not limited to withholding city employee email addresses in the from/to/cc/bcc), failure to provide native formats, failure to provide textual PDFs, failure to preserve color, hyperlinks, and other formatting from original records by printing and scanning in black and white, and thus an overall failure to provide exact copies. Some, but not all, of these issues should be adjudicated before the Oct. 2 SOTF en banc hearing as you also are well aware. Please do not destroy original records to avoid production under SOTF, Court, or Supervisor of Records order.

This is a request for a 7-day 67.21(c) statement for quantity, nature, form, and existence of each request made on Sept. 11. In addition for the Mayor, I would like a separate statement for each of each her official email addresses - there is evidence that she has at least 2 of them. Also, as a reminder I made separate requests for personal accounts vs govt accounts - so I expect distinct 67.21(c) statements for them. If you would like me to rewrite each as a question, I am happy to do so.

Re: keywords - While you are not permitted to discriminate based on the purpose of my request, I will volunteer that part of my purpose is to investigate whether the Mayor's office knew or should have known about any concerns with Mr. Adachi prior to his death (not just the Carmody raid), and whether there are or were any political maneuverings by the Mayor's office regarding the role of the public defender before or after his death. Therefore the keywords "adachi" and "public defender" are crucial and I will not exclude them.

However, if and only if the Mayor's office agrees to not destroy potentially responsive records (even through regular or automatic retention expiration), I am willing to defer search, production, and 67.21(c) statements for records for (only) "public defender" until after production for the other 2 keywords.

Sincerely,

Anonymous

Dear Anonymous,

This is in response to your request of September 24 seeking a description under Admin. Code 67.21(c) of records responsive to your request of September 11. We have already provided responsive documents on September 23, 2019 and are continuing our processing of responsive records among the sources identified by you in the Office of the Mayor containing the terms "Adachi", "Carmody", and "North Bay News". We provide the following general description of the types of records located in that search and review:

- Records relating to news clips and media stories relating to Jeff Adachi and/or Bryan Carmody;

- Records relating to the swearing in of Jeff Adachi as Public Defender;

- Records relating to legislation supported by the Public Defender's office;

- Records relating to memorializing Jeff Adachi;

- Records relating to press inquiries, press statements and announcements relating to the death of Jeff Adachi and/or the search of Bryan Carmody's home;

- Records relating to appointing a new Public Defender following the death of Jeff Adachi;

- Records relating to sunshine requests and responses;

- Records relating to constituent communications regarding the death of Jeff Adachi and/or the search of Bryan Carmody's home;

- Social media posts regarding the death of Jeff Adachi and the appointment of Manohar Raju as Public Defender.

The documents described number in the tens of pages and exist in electronic Microsoft or PDF formats.

Regarding the Mayor's city email accounts, the records include the following types of records: news clips, records relating to legislation, records relating to the appointment of a new Public Defender; and constituent communications.

Thank you Mr. Heckel.

I responded to your earlier question with: "However, if and only if the Mayor's office agrees to not destroy potentially responsive records (even through regular or automatic retention expiration), I am willing to defer search, production, and 67.21(c) statements for records for (only) "public defender" until after production for the other 2 keywords."

Since you did not include "public defender" in your response, did the Mayor's Office agree?

Thanks,

Dear Anonymous,

Please see the additional responsive information to your request below.

I don't understand why you are still printing and re-scanning records.... the Oct. 2 task force in 19047 was pretty clear about the inappropriateness of that as a method of records delivery.

From: Anonymous Person

Is this request complete? I've gotten only 69 pages of records for one of the most newsworthy incidents in recent SF history, and haven't heard anything in a month. Rolling responses were required. I will be beginning the appeals process.

Again, we know your office knows how to produce records in at least PDF text format with redactions, since you have done it many other times and physical printing serves solely to obfuscate the record and is not an exact copy of the record.

Dear Anonymous,

Please see the supplemental production of records responsive to the referenced request.

The responsive information has been provided in an OCR'ed PDF format for its ease of transferability and accessibility, consistent with Cal. The OCRing should obviate your concerns regarding the print vs. scanned format of the records.

Please note that certain private information like personal email addresses and cell numbers has been redacted to protect personal privacy. See Cal. Govt. Code Secs. 6254(c), California Constitution, Art. I, Sec. 1.

Nope. OCR will also be appealed. There is no reason not to convert directly from Outlook to a text PDF and redact in Adobe. The City (and I believe your office itself) has done this in the past. No chance SOTF is going to hold even mere conversion to PDF is not an easily generated format. Your Office is just trying to make life difficult for requestors at this point and all withholdings and incorrect productions will be appealed to the end.

For example, by printing and using OCR you have unlawfully withheld without justification the following in this collection:
- dozens of hyperlinks on pg 67-77
- tweet link pg 55
- the possible link on pg 3
(also the metadata, but that is a separate issue).
I have no obligation to have to tell you about these individually. I requested the full email originally.
Furthermore printing and scanning is not an exact copy (GC 6253(b)) of the original record.

The complaint in this case will be filed tomorrow as I have various other appeals to work on today.

Separately the lack of BCC on pg 45 will be used as further evidence for why lack of metadata unlawfully withholds public information unrelated to computer encoded data.

Sincerely,
Anonymous

This request is an example of one your office is still producing by printing and scanning.

I know for certain your office knows how to use PDFMaker. Here's an example of a record your office produced with PDFMaker: https://cdn.muckrock.com/foia_files/2019/11/01/Re__Boeddeker_Park_5_year_Anniversary.pdf

You can use PDFMaker to produce PDFs with text, hyperlinks and attachments and AND strip metadata if you so choose.

Thank you for providing an acceptable format and some or all of the metadata.
Do you consider this request complete? Did you withhold any metadata, and if so under what justification?

This is also a question regarding your office's position. If you would prefer I pose it orally, I can arrange that:
1. Does the Mayor's office now consent to production as a disclosable public record of some, none, or all email headers? Is there any reason for its apparent change in position?

Mayor's Office,

Can you please indicate whether your response to this request is complete?
For a total of approx. 175 pages, it has been many months now.
If no answer is forthcoming, I will be filing the complaint after close of business today.

(When I say complete I mean in full compliance with the Sunshine Ordinance:
- all records provided - SFAC 67.21(b),
- minimally withheld -67.26,
- all information (whether a full record or a part) that is withheld justified in writing by specific provisions of law -67.27,
- every maskings/deletions/segregation keyed by a clear reference or a footnote to the associated justification(s) -67.26,
- no exemption justifications are prohibited in the City -67.24/67.27,
- all easily generated formats requested provided -67.21(l),
- determinations of whether or not you had records and whether you withheld any -Gov Code 6253(c))

As a reminder I asked for searches of chat/text/etc. apps including personal, which will likely contain some of the most interesting material (if there is any). I have received no determination of whether such records exists.

You have provided the following 4 sets of records:
https://cdn.muckrock.com/foia_files/2019/09/23/Responsive_Request_re_Anonymous_Request_re_Adachi_Communications_Audit.pdf
https://cdn.muckrock.com/foia_files/2019/10/07/Anonymous_Request_re_Adachi_2.pdf
https://cdn.muckrock.com/foia_files/2019/11/13/Second_Supplemental_Response_to_Anonymous_Request_Re_Adachi.pdf
https://cdn.muckrock.com/foia_files/2020/01/24/Inbox.pdf

The sole redaction reason provided so far is Constitutional privacy.
No reasons for withholding entire records has been provided, nor any determination of whether or not you did so.
(You've given my your usual metadata withholding reason and your usual printing/scanning reasons too. Obviously those don't hold up any more, but that'll be taken up at SOTF.)

1. Are you representing that all of these are supplemental 'public defender' responses? https://cdn.muckrock.com/foia_files/2020/02/07/Supplemental_Shaban_3.pdf clearly says Adachi in it and was responsive to requests under 'adachi'. What's going on here?

2. Why is your office still producing records like this....
https://cdn.muckrock.com/foia_files/2020/02/07/Supplemental_Production_Re_Public_Defender.pdf#page=23 (page 23)
https://cdn.muckrock.com/foia_files/2020/02/07/Supplemental_Production_Re_Public_Defender.pdf#page=25 (page 25)

This is not just unlawful under SFAC 67.21(l) as a matter of principle - I'd argue its not even a copy of the record under SFAC 67.21(b), as the record is being ruined. What happened to using PDFMaker?

Is your office still taking the position that physically printing and scanning emails (even with OCR) is lawful under the Sunshine Ordinance? Indeed, you don't have to answer the question in writing, but if you don't, I have to file ever more complaints as that is the only way things appear to get resolved. I *know* for certain that you know how to use PDFMaker and give me the much closer to exact copy PDFs that it makes.

3. Is your response complete now? What happened to the personal account searches and text/chat/SMS/app searches? If there are no responsive records on those please represent as such. Obviously there *were* such messages you gave within these attachments to other persons....

This is a follow up to a previous request:

Mr. Heckel and Mayor's Office:

This is quite important, so I am adding a 4th issue:

4. Did you BCC anyone on the following 3 emails: https://cdn.muckrock.com/foia_files/2020/02/07/LaRoe_Forward.pdf , https://cdn.muckrock.com/foia_files/2020/02/07/Aponte_Request.pdf , https://cdn.muckrock.com/foia_files/2020/02/07/Glen_Smith_Forward.pdf . If you did, your withholding of the names of the BCCs, which is something you typed in yourself, is not computer-generated, and would in fact be visible on the face of your Outlook record is unlawful , is not justified under any of the metadata justifications you cited (even if you were correct about them, which you are not).

The prior 3 still stand:

Anonymous,

We produced supplemental records responsive to the generic "public defender" term. We also searched responsive documents within the sunshine inbox and related communications concerning overlapping requests. We have produced such records. Note that due to the overlap of your request and some of these other requests, many of the documents we have provided are duplicative of documents you already received.

Please note that certain documents have been withheld on the basis of the attorney-client privilege and/or the attorney work product doctrine. Gov't Code § 6254(k); Evid. Code § 954; Code of Civ. Proc. § 2018.030; Gov't Code § 6276.04; Admin. Code § 67.21(k).

We consider our production in response to this request substantively complete.

We are willing to work with you regarding disputed issues concerning format and supplement further on that basis as appropriate.

Hank Heckel

There were BCCs. We did not intentionally withhold that information. How would you propose we provide that?

From: Anonymous Person

I understand that you claim that you are not *intentionally* withholding it, but you are nevertheless, withholding it, and your present justifications cannot cover BCC recipients. This is of course why I will continue to completely pursue all headers - government officers cannot be allowed to communicate in secret. And I will be using this as evidence in the many other metadata cases pending.

Please provide me one of those three emails using PDFMaker if that will preserve the BCCs.
Let's see if that works.

It is now ~5 months since this request was issued.
It has been 2 weeks since you stated you would produce the emails correctly.
Please let me know prior to 1pm today whether or not you will be correcting these productions using full-fidelity PDFMaker PDFs; complaints will be filed at that time.
Print-and-scan is never an actual copy of an electronic record, and it will be appealed every time.

1. You continue to produce emails in printing and scanning fashion to me.
2. I have examined the Office of the Mayor's response to certain other requesters as well where you continue to do the same thing (printing and scanning) even though you know it unlawfully withholds certain information and is not a copy of the record.

By printing and scanning, your office continues to intentionally deprive both me and others of the color, formatting, BCCs, hyperlinks, and even just the text of emails (not to mention the headers) in a way that is neither a copy of the electronic record nor a minimal withholding.

We will be filing complaints for each and every request made to the Office of the Mayor until you stop your unlawful practice of withholding more than minimal portions and making actual electronic copies of emails.
