Pursuant to the California Public Records Act, I hereby request the following records:

1. the total number of use of force incidents, separated by year and by type of force used from 2019-2020 (for example, "27 taser incidents in 2019, 3 baton incidents in 2020, etc.)

2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained in 2020.

3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained in 2020.

4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained in 2020.

5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained in 2020.

6. all information reported to the FBI’s National Use-of-Force Data Collection program to date.

Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Response: The Sheriff's Department is providing the "Annual Report of Civilians' Complaints Against Peace Officers" in response to this request.

Response: The Sheriff's Department is providing the "Annual Report of Civilians' Complaints Against Peace Officers" in response to this request. Request: all information reported to the FBI’s National Use-of-Force Data Collection program to date. Response: The Sheriff's Department has no records responsive to this request.  The data for the FBI is entered directly into the FBI database.  You may direct this request to the FBI as they maintain the database. The Sheriff's Department tracks use of force using the SO-120 form and investigative reports.  Specific information is compiled from these two reports into a spreadsheet that is utilized by the Division of Inspectional Services to track use of force.  The SO-120 forms and the investigative reports themselves are exempt pursuant to Government Code section 6254(f).  Records of a law enforcement investigation, or any investigatory or security files compiled by a law enforcement agency are exempt from disclosure. Cal. Gov't. Code § 6254(f); Haynie v. Superior Court, 26 Cal. 4th 1061, 1071-72 (2001). Please contact the Sheriff's Department if you seek data fields from the spreadsheet that is utilized by the Division of Inspectional Services to track use of force.  Please identify the information and time range that you seek.  The Sheriff's Department reserves the right to assert any applicable exemptions and privileges.  The Sheriff's Department is providing a copy of the SO-120 Use of Force Report to show the data fields that are collected.
