In regards to your Public Records Act Request, FY20172018.157. This letter shall constitute the District’s initial response under the California Public Records Act (“the Act”) and is not intended to be exhaustive. The District reserves the right to amend its initial position following a careful search for and review of records and identification of additional exemptions.

Generally Applicable Response to Request for Records
Pursuant to the Act, we will make non‐exempt responsive documents in our possession available as soon as they are identified and compiled. We will be exercising our discretion to withhold exempt records. Specifically, we will not be providing the following:

* Records that fall within the exemption provided for by Government Code section 6254(a) (preliminary drafts, notes, or interagency or intra‐agency memoranda that are not retained by the public agency in the ordinary course of business, if the public interest in withholding those records clearly outweighs the public interest in disclosure);

* Records exempt from disclosure pursuant to Government Code section 6254(c);

* Records exempt from disclosure pursuant to Government Code section 6254(f) (records of complaints to, or investigations conducted by the District);

* Records exempt from disclosure pursuant to Government Code section 6254(k) (exempt or prohibited from disclosure pursuant to federal or state law, including, but not limited to, provisions of Evidence Code related to privilege); and

* Protected individually identifiable health information exempt from disclosure under the “public interest” exemption in Section 6255 of the Act.

In those cases where it is possible to redact information from an otherwise exempt record, we will do so and make available to you the redacted record. Pursuant to California Government Code section 6253(c), which entitles public entities to recover the reasonable costs to produce records, the District only provides copies upon receipt of payment for costs of copies, which is $.10 per page. I will notify you if there are any costs associated with your request once I have determined how many responsive documents there are.

Finally, to the extent that any of the records you seek can be found via our District website (www.sandiegounified.org<http://www.sandiegounified.org>) we will not provide copies of those documents as they are available to the public 24 hours per day, 7 days per week. We will endeavor to provide you with links to such records whenever possible.

In response to your requests, the District responds as follows:

Initial Response: You have not supplied us with any names of any officials, employees, representatives and/or agents, to be utilized in searching for these communications. As currently phrased your request is overly burdensome. Your request lacks the specificity required to conduct a proper search for documents. Therefore, in order to conduct this search, we would need to search all the communication files, email accounts and files for 13,559 District employees. If you wish to modify this request by identifying specific employees we will re‐evaluate your new request. As presently framed, the public interest served by not disclosing the records clearly outweighs the public interest served by disclosure of the records. Without modification, we will consider this portion of your request closed as of today’s date and update our files accordingly.
