Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:
Records of overtime pay sorted by employee and salary sorted by employee (exclusive of overtime) for 2012-2013, in Excel or similar spreadsheet format.
I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Musgrave/ Mr. LeVines:
The Salem Police Department is in receipt of your requests for specific information as they pertain to the Massachusetts Public Records Law.
I have been informed by the Records Division there may have been a delay in receiving said requests due to our email filters, etc. therefore as you will note this response is outside the prescribed ten day period.
In reviewing your earliest dated requests you are seeking information detailing a security presence in the schools including documents regarding police tactics and records of arrests / citations given to students. The department relies on Investigatory Exemption G.L. c. 4, s. 26(f) in denying the first part of the request as the tactics and details of the security presence in our schools are ....."compiled out of the public view by law enforcement or other investigatory officials the disclosure of which materials would probably so prejudice the possibility of effective law enforcement that such disclosure would not be in the public interest."
As to the second part of the aforementioned request, releasing the records of arrests / citations given to students your request is hereby denied citing a Statutory Exemption as there is a mandatory withholding of juvenile records under G. L. c. 199 s. 60A as citations would include the names of students. Should you not be seeking the names of the individuals you would need to refine your request to include date parameters.
Your request dated October 24, 2013 appears to have been misdirected to the Salem, MA police department when in fact after a review of your on-line requests that are posted you intended to direct it to Salem, Oregon. If this is not the case please be advised that the Salem, MA police department does not utilize drones therefore we do not have any of the supporting documents listed.
In reference to the request pertaining to Vigilant Solutions, Vigilant Video and NVLS, the Salem, MA police department does not contract with or utilize the above listed company / products.
The Salem Police Department does use ALPR technology and follows the guidelines as set forth by the Commonwealth / CJIS. Documents can be obtained through the state / CJIS as the policy did not originate with the Salem Police Department.
I have requested of the training officer and Armorer a list of the firearms and protective gear currently in use. I will forward to you as soon as it is made available. As for our surveillance equipment and tactical and defense equipment we decline to provide that information the rationale being that it is part of the Investigatory Exemption in that we would reserve the right to prevent the disclosure of confidential investigative techniques and procedures as it would jeopardize the safety of our personnel and investigations.
Records of overtime pay sorted by employee and salary can be obtained through Salem City Hall / Treasurer's Office as they are the official keeper of those records and release said statistics annually to the media.
Lastly, in response to your request for all controlled substance seizure reports since January 1, 2006. Chapter 94C, Section 47A reads " The department of state police shall keep a complete record of all drugs received and of all drugs disposed of, showing the exact kinds, quantities and forms of such drugs; the persons from whom received and the dates of receipt, disposal or destruction, which record shall be open to inspection by all federal and state officers charged with enforcement of federal and state narcotic laws. Prior to the most recent amendment it also included attorneys of record in the case. From what we have gathered neither Mr. Musgrave/ Mr. LeVines or Muckrock fall into the aforementioned category for which the documents are open to inspection.
