We have located the records responsive to your request for the year 2019 and January 1, 2022 to April 27, 2022, and those records are available in the Records Request System.  Please log in to your online account to retrieve the records. Please note: For the years 2020 and 2021, you have already been given the documentation in response to request numbers C000599-111021 and C000017-010622, so that portion is a repeat request. Redactions: While the records you requested were provided to you, redactions have been made for privacy reasons. The courts have allowed redactions in order to substantially comply with CPRA requests. Where non-disclosable portions of public records are “reasonably segregable” from the disclosable portions, the agency may withhold or redact the non-disclosable portions while producing the disclosable portions. Thus, redactions are permitted under the CPRA, as long as the basis for the redaction (specified exemption) is identified in the agency’s response. See Cal. Gov. Code § 6253(a); American Civ. Liberties Union Found’n v. Deukmejian (1982) 32 Cal.3d 440, 452-454. The exemptions asserted for our redactions are: Government Code § 6254(k)- read in conjunction with Article 1, § 1 of the California Constitution provides that personal information details are subject to privacy rights that make such information exempt from disclosure. Government Code § 6255- the records in question are exempt because under the facts of the particular case the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record. Here, the public interest in disclosure of the Department's service of legal process asrequested is to establish that the Department is carrying out their duty to provide such processservices to the public. However, providing the name and address of the individuals who were thesubject of such process service does not serve the legislative purpose of shedding a light on the Department’sstatutory duties. Instead, such light is shed by the data that the Department is willing to disclose, such as thetype of judicial process service provided, the name of the deputy who carried out such service, etc.See City of San Jose v. Superior Court (1999) 74 Cal.App.4th at 1023 (finding “t he public interest indisclosure of personal information about airport noise complaints is minimal, because City has madeavailable all the information it has concerning airport noise complaints is minimal, because City hasmade available all the information it has concerning airport noise complaints, except for the names, addresses, and telephone numbers of the complainants. The information provided by City in itsmonthly noise report and data base printout is extensive, and indicates the date, time, and nature ofeach complaint, as well as the city area where the complaint originated. Not only does the monthlynoise report provide a comprehensive overview of the City’s performance of its state-mandated dutyto report airport noise complaints, the report also provides the Mercury News with information thatwill aid it in further investigation of the complaints.”)

Please consider this CPRA request closed.

Sincerely,

Sergeant Justin Pittenger J.D.
