Emails, letters, and memos to or from police/law enforcement unions, the National Guard, or federal officials between May 1, 2020 and the present.

I also request copies of emails containing any of the following: "protest", "protests", "Black Lives Matter", "BLM", "riot", "riots", "antifa", "antifascist", "anti-fascist", or "militia".

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Riverside County Sheriff's Department received a public information request from you on June 09, 2020. Your request mentioned: "Pursuant to the California Public Records Act, I hereby request the following records:
1. Emails, letters, and memos to or from police/law enforcement unions, the National Guard, or federal officials between May 1, 2020 and the present.
2. I also request copies of emails containing any of the following: "protest", "protests", "Black Lives Matter", "BLM", "riot", "riots", "antifa", "antifascist", "anti-fascist", or "militia"."
The Riverside County Sheriff's Department has reviewed your request and has determined that the records requested are exempt from disclosure under the California Public Records Act (CPRA) for the following reasons:
Government Code § 6255- the records in question are exempt because under the facts of the particular case the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record.  This request covers in excess of 3900 employees, which during the time frame requested, generated approximately two hundred ninety seven thousand four hundred nineteen (247,419) items. Disclosure efforts in response to the request would require the utilization of hundreds of hours of staff time in retrieval, review, administrative oversight review, the segregation of exempt from non exempt information and actual copying time efforts such that the burdens and costs would be substantial. As such, the request is excessively overbroad based on the burdens and costs involved. See County of Santa Clara v. Superior Court, 170 Cal. App. 4th 1301, 1321 (2009). California law requires that a “specific and focused request” must be provided under the CPRA. See California First Amendment Coalition v. Superior Court, 67 Cal. App. 4th 159 (1998); Rogers v. Superior Court, 19 Cal. App. 4th 469 (1993). Moreover, a request may be objectionable as unduly burdensome where it requires an agency to search an enormous volume of data for a “needle in a haystack” or, conversely, where a requests compels the production of a huge volume of material. See California First Amendment Coalition v. Superior Court, 67 Cal. App. 4th 159, 166 (1998).
The key words used resulted in an excessive amount of items, so excessive that attempts to export the information resulted in an error/incomplete process.  If you would like to resubmit your request with a narrower search criteria please use the Transparency portal found here on our website https://www.riversidesheriff.org/663/Transparency to file a new CPRA request.  I understand that with MuckRock News each request has its own specific email address therefore you will essentially be creating a new account for every request you make, however, there is less chance of errors when you enter the information versus when my staff enters the information from your emails.
