The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Richmond Redevelopment and Housing Authority (RRHA) acknowledges receipt of your FOIA request, dated January 15, 2020 received on January 28, 2020.

Upon further review a response will be provided to you within 5 business days of your initial request date. Day 1 is considered the day after your request is received. The five-day period does not include weekends or holidays.

If it is not practically possible to identify, locate, or provide the records you requested within 5 business days, RRHA may require an additional 7 days to respond to your request pursuant to Va. Code § 2.2-3704(B)(4).

Mr. Nash,

A review of Ms. Walton’s Outlook account indicates that there are at least 1,539 separate email messages which include either the word “Creighton” or “demolition.”

Pursuant to Va. Code § 2.2-3704(F), a public body may make reasonable charges not to exceed its actual costs incurred in accessing, duplicating, supplying, or searching for records requested under FOIA. As a courtesy, RRHA generally provides many easily accessible documents free of charge. However, RRHA charges a reasonable fee for documents which take an unusual amount of staff time or resources to access, compile, or review.

To effectively comply with your request, RRHA legal staff must review each of the 1,539 messages responsive to this request for information which RRHA is either entitled to withhold under FOIA, or prohibited from disclosing for other reasons (such as the Federal Privacy Act). For any message which contains material which RRHA will withhold, RRHA administrative staff must manually duplicate or digitize the message to prepare it for redaction. Once redacted, RRHA legal staff must identify each of these 1,539 messages which has been withheld or redacted, and both (i) individually characterize each piece of information which has been withheld or redacted, and (ii) identify the specific FOIA exemption which applies to each individual message to be withheld or redacted.

Given the breadth of this request, RRHA must charge for its actual costs in responding to this request. Costs will be billed at a rate per hour of staff time equal to the actual rate of pay (exclusive of taxes and benefits) of the lowest-paid employee qualified to handle the relevant documents. We anticipate that these costs will exceed $200. Accordingly, and pursuant to Va. Code § 2.2-3704(H), RRHA will require your organization to pay a refundable $200 deposit before work is initiated to compile RRHA’s response to this request. Any amount of this deposit which is not actually incurred by RRHA will be refunded to you once work is complete.

Please advise if you wish RRHA to undertake this work upon receipt of your deposit, or if there is another way that RRHA can provide information which suits your purposes with this request.
