Pursuant to the Rhode Island Access to Public Records Act, I hereby request the following records:

All communications with state Representative Justine Caldwell and her staff from January 1, 2019, and until the processing of this request regarding Antonio Giarrusso, Chad Callanan, budgeting, warrant, arrest, and/or David Caldwell.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

We are in receipt of your Public Records Request seeking "all communications with state Representative Justine Caldwell and her staff from January 1, 2019, and until the processing of this request regarding Antonio Giarrusso, Chad Callanan, [sic] budgeting, warrant, arrest, and/or David Caldwell." Your request is governed by the Access to Public Records Act contained in R.I.G.L. Chapter 38-2. In response to a request for public records, an agency is required to make available for public disclosure those records that are responsive to a request, are in the possession of the agency and are not otherwise exempted from disclosure.

Please be advised that this office does not maintain, as you request, records of all communications involving members of the General Assembly. However, if such records did exist they would be exempt from public disclosure in whole pursuant to Rhode Island General Laws § 38-2-2(4)(M) which exempts "correspondence of or to elected officials with or relating to those they represent and correspondence of or to elected officials in their official capacities."

Accordingly, email communications that are kept by the Office of Legislative Data are also exempt from public disclosure in whole pursuant to Rhode Island General Laws § 38-2-2(4)(M).

In accordance with R.I.G.L. § 38-2-8, you may appeal this decision to Frank Montanaro, JCLS Director, at 82 Smith Street, Providence, RI 02903; or, you may file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, Rhode Island, 02903, or the Rhode Island Superior Court of the county where the record(s) are maintained.
