To Whom It May Concern:

Pursuant to the Rhode Island Access to Public Records Act ("APRA"), I hereby request the following records:

Written procedures for access to the agency’s public records, including any
records request forms required or suggested by the agency

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Shawn Musgrave

Hello,

After sending the followup email below from our primary email service (which was sent from requests@muckrock.com), we received a notification indicating that our system had been blocked by ProofPoint. Please confirm whether the emailed APRA request and numerous followups below has been received.

Another APRA request for contract information was received and processed on April 29, but the request below was submitted March 31 and has yet to be processed despite several emails and two phone calls to OAG administration.

Mr. Hoyle -

I am emailing once again to note that your office has yet to respond to this request under the APRA for your office's APRA procedures. As amended in 2012, the APRA requires each public body to establish written APRA procedures, as well as to post such procedures online.

At this point, the OAG is in clear violation of the obligation to respond to requests within 10 business days. Nor have I been able to locate any APRA procedures posted on the OAG website.

Please advise immediately.

Respectfully,
Shawn

Shawn:

We are in the process of reviewing our specific APRA procedures to ensure compliance with the General Laws. Upon completion of our review we will include those procedures and the designated contact person on our website. I expect that we will complete our review and include all required information on our website by the close of this month.

In the meantime, you may contact me directly with any public records requests.

Mr. Hoyle -

Your response of yesterday suggested that your office currently has written APRA procedures. If this is the case, please provide them in their current form per your obligations under the statute. If that is not the case, please confirm that the OAG does not have written APRA procedures at present.

Respectfully,

Shawn
