To Whom It May Concern:

Pursuant to the Rhode Island Access to Public Records Act ("APRA"), I hereby request the following records:

A spreadsheet, database or other summary of all employees who received payout upon leaving the agency in 2013, as well as what those payouts were.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Dear Mr. Musgrave,

We are in receipt of your Public Records Request, dated June 9, 2014. Access to the information requested by you will be governed by the Access to Public Records Act, R.I. General Laws ยง 38-2-1 et. seq. If the records you seek are deemed to be public records, please be advised, there may be costs incurred for search and retrieval as well as for any copies required in the event the records you request are not maintained in electronic format. Per section 38-2-4 (a), "the cost per copied page shall not exceed fifteen cents ($.15) per page and (b) hourly costs for search and retrieval shall not exceed fifteen dollars ($15.00) per hour and no costs shall be charged for the first hour of a search and retrieval." Once your request is reviewed and if it is determined that the search and retrieval will be in excess of one hour and/or copies of the documents are required, you will be provided with an invoice. Once this Office receives payment in full, search and retrieval of the records you request will commence.

Please be advised that payment does not guarantee that the records you have requested constitute public records (in whole or in part), but only authorizes this Office to conduct its search and retrieval to determine if responsive records exist, and if so, whether they are public records. Should actual search, retrieval, and copying fees exceed pre-payment, this Office will contact you to seek authorization before continuing. Should your pre-payment exceed actual search, retrieval, and copying fees, you will of course be reimbursed.
The time period for this Office to respond to this request is tolled as of the date of this letter, pending pre-payment and authorization.
