Pursuant to the Nevada Public Records Act, I hereby request the following records:

All reports to the University's police department from the year 2020 to 2021.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The University responds to your request as follows.

The request is overbroad. No specific record has been identified. In order to inspect or copy a public record, the specific record must be identified by the person requesting the document. Courts in addressing this issue have held that "agencies are required to disclose only 'identifiable' governmental records not otherwise exempt. Wholesale requests for general information to be analyzed, collected and compiled by the responding government entity are not encompassed therein." Hodai v. City of Tucson, C20141225 (Ariz. Super. Ct. 2014) citing mag Entertainment LLC v. Div. of Alcohol Beverages Control, 868 A.2d 1067, 1076 (N.J. Sup. Ct. App. Div. 2005). A government agency is not required to respond to an overbroad request that does not request specific records. Id. at 1074, citing Capitol Info. Assoc. v. Ann Arbor Police, 360 N.W.2d 262, 263 (1985).

The request is also unclear as to timeframe and whether the request covers one or two years.

The University estimates that the number of reports potentially covered by this request would be 450. The University would have to determine as to each report whether the matter is still being investigated. If the matter is still being investigated, the balancing test weighs in favor of keeping police reports confidential. Donrey of Nevada v. Bradshaw, 106 Nev. 630,. 798 P.2d 144 (1990). Moreover, certain information is made confidential by FERPA and other laws. Each report may be subject to redaction of information made confidential by law.

For all these reasons, the University offers to work with you to narrow and/or focus your request to specific, identifiable records so that you will be able to inspect or receive a copy of the records as expeditiously as possible.

The University will await direction and/or contact from you regarding working with the University to narrow and/or focus the request. Please confirm that you would like to narrow the request or that you would like to discuss the request and ways to narrow it with the University. You may also decide to withdraw the request and submit a narrower one.
