Any body camera footage worn by patrol officers at the University of Nevada, Reno in the years 2018-2020

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The University responds to your request as follows.

The request is overbroad. No specific record has been identified. In order to inspect or copy a public record, the specific record must be identified by the person requesting the document. Courts in addressing this issue have held that "agencies are required to disclose only 'identifiable' governmental records not otherwise exempt. Wholesale requests for general information to be analyzed, collected and compiled by the responding government entity are not encompassed therein." Hodai v. City of Tucson, C20141225 (Ariz. Super. Ct. 2014) citing mag Entertainment LLC v. Div. of Alcohol Beverages Control, 868 A.2d 1067, 1076 (N.J. Sup. Ct. App. Div. 2005). A government agency is not required to respond to an overbroad request that does not request specific records. Id. at 1074, citing Capitol Info. Assoc. v. Ann Arbor Police, 360 N.W.2d 262, 263 (1985).

The request is for "any" body camera footage worn by officers for a three year period. The request is a broad demand, not a request for a specific record. The request also covers a lengthy (3 years) period of time for records. The University has approximately 544 videos for 2018, 803 videos for 2019, and 676 videos for 2020. NRS 289.025 makes a photograph, such as a video, of a police officer confidential. A video of the type requested would have to be reviewed and redacted to the extent that it included a depiction of a police officer. The University estimates that over 8,000 hours would be required to redact the videos in accordance with NRS 289.025. The University is aware that the length of time required to redact the videos in accordance with the statute may not be compatible with the time frame of your need for the records.

For all these reasons, the University offers to work with you to narrow and/or focus your request to specific, identifiable records so that you will be able to inspect or receive a copy of the records as expeditiously as possible.

The University will await direction and/or contact from you regarding working with the University to narrow and/or focus the request. Please confirm that you would like to narrow the request or that you would like to discuss the request and ways to narrow it with the University. You may also decide to withdraw the request and submit a narrower one.
