Pursuant to the Nevada Public Records Act, I hereby request the following records:

Data on all cases of: unsolved missing persons, homicides, suspicious deaths, and deaths in custody involving an Alaska Native/American Indian woman or girl victim within your jurisdiction(s). For the purposes of this request, "Alaska Native/American Indian" is defined as any individual who was identified as a member of an Alaska Native or American Indian community or as having Alaska Native/American Indian heritage. "Woman or girl" includes all victims identified as females, as well as transgender women. If there are any Jane Does that have been identified as potentially Alaska Native or American Indian, please include them as well. We are requesting cases dating from 1900 to the present.

This request is for basic information on cases as classified above. Such information may include but is not limited to victim name, location and date of disappearance/death, age of victim, status of case (solved or unsolved).

Please note an initial request for these records was filed approximately 9 months ago, which still has not been filled.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Annita, Your public records request seeks information from 1900 to present.  Specifically, you are requesting data on “all cases of unsolved missing persons, homicides, suspicious deaths, and deaths in custody involving and Alaska Native/American Indian women or girl victim within your jurisdiction.”  After review, RPD does not believe it can fulfill the request for reasons which will be described below.  As you know, NRS 239.010(4) provides that a person may request a copy of a public book or record in any medium in which the public record is readily available. Your request is broad and voluminous as it covers over 118 years of cases and information which may be included in such cases.  To the extent that the data might exist, the information you are seeking exists across thousands of different records in a way that is not readily available. Nevada law does provide that when an agency has a computer program that can readily compile the requested information, the agency is not excused from its duty to produce and disclose that information. ( LVMPD v. Blackjack Bonding , 343 P.3d 608, 613 (2015).) However, the information you are seeking cannot be readily compiled, even using computer programs.  When a records request requires an agency to “ create new documents or customized reports by searching for and compiling information” from individual files or records, NRS 239 does not require their production and disclosure. ( Id.)  That is exactly the case with the information you have requested.  While it might exist (across thousands of case files), it cannot be sorted and exported without significant staff time devoted to going case by case and entering that data into a new document/medium. The public records law does not obligate RPD to undertake that task to create a new record.  In light of this, RPD does not maintain any records that are responsive to your request.
