8. Where no such records in the above categories exist, please provide a written statement to that effect.

Disclosure of the requested policies and data is in the public interest because it is likely to contribute to public understanding of the intersection of school policing, immigration policy, and the juvenile justice system. To the extent there are the costs associated with the production of these documents, we request they be waived considering that we are a non-profit organization. Should you determine that some portions of the documents are exempt from disclosure, please release any reasonably segregable portions that are not exempt. In addition, please note for any such redactions the applicable statutory exemption and explain why it applies to the redacted or withheld information. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Per Attorney Gen. v. Dist. Attorney for Plymouth Dist., 484 Mass. 260, 141 N.E.3d 429 (2020), compiling information from a database is not tantamount to creating a new record that would otherwise be precluded under public records law. Specifically: “Where public records are in electronic form, a public records request that requires a government entity to search its electronic database to extract requested data does not mean that the extracted data constitute the creation of a new record, which would not be required, under the public records law. " Id. at 442 to 443. Thus, we request that your department query its database and provide a response to data requests above.

We requested these records previously in June of this year, but received no response. If we do not receive a response to this public records request within ten business days, we will be filing an appeal with the Secretary of the Commonwealth's Public Records Division.

Thank you in advance for your anticipated cooperation in this matter.

Sincerely,

Joshua Dankoff
Director of Strategic Initiatives, Citizens for Juvenile Justice

From: Quincy Police Department

Mr. Dankoff,

On September 23, 2021, we received your request (attached) pursuant to the Massachusetts Public Records Law.

In response, please review the following (listed sequentially in concert with your request):

1. a. No responsive record as no agreement or memorandum of understanding between the Quincy Police Department and Federal immigration authorities is in the Department’s possession
b. (see attached)
c. No responsive record as no agreement or memorandum of understanding between the Quincy Police Department and the Quincy Public School Department is in the Department’s possession

1. No responsive record as the Department does not have policies relating to the gathering and storing of information regarding gangs, security threat groups or high-risk individuals and does not maintain a “gang database”

1. (see attached)

4. The requested information is not readily attainable and as you will see, quite costly to produce.

To comply with this portion of your request, the Department is required to search for, compile, segregate, redact and/or reproduce the requested records; and the segregation or redaction of records is required by law. As a total of 5,428 emails exist between the Department and the identified entities (BRIC & Fusion Center) within the time indicated, the total reasonable fee of $ 6725.00 will be charged for this portion of your request. This fee must be paid in full prior to the requested records being provided.
The search and segregation costs for this portion of your request have been calculated using the hourly rate of $ 25.00 per labor hour. To comply with your request, it will take approximately two hundred and seventy-one (271) hours of search and segregation time, based upon the following:

5428 records X 3 min/record (est.) = 271 hours

As required by law, the first two (2) hours of labor will be provided by the department with the remaining seventeen (269) hours representing the estimated fee charged.

Check or money orders are payable to the City of Quincy and can be sent to the following address:

Quincy Police Department
Attn: Lt. McDonnell
1 Sea Street
Quincy, MA 02169

5. (see attached)

6. No responsive record as the Department does not maintain records for individuals identified as gang affiliated, gang involved or part of a “threat risk group” and does not maintain a “gang member database”

7. No responsive record as the Department does not maintain such data. I suggest contacting the Quincy Public School Department at (617) 984-8700 for assistance with this portion of your request.
