Pursuant to the Colorado Open Records Act, I hereby request the following records:

We are Economics Professors in the College of Business at Ferris State University, and are engaged in an empirical research project on police behavior and citizen complaints. This project requires us to request data from your department. If you have questions about this request or suggestions, we would be happy to discuss them with you.

1. How many officer-involved-shootings were there per year for the last 10 years in your department? Any documentation or reports that detail the annual number of officer-involved shootings in your department for the past 10 years would be sufficient.

Please include documentation regarding how many of these officer-involved shootings involved disciplinary action. (Please list officer firearm discharge directed at a person separately from a shooting involving an animal and separately from accidental firearm discharges).

Please include the number of officer-involved shootings resulting in discipline.

2. Which of the above data are published publicly? Please provide a link to any and all publicly available reports containing the data above.

Collecting this information is very important to our research, so we would like to emphasize, if you have questions about my request or suggestions, we would be happy to discuss them with you.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is a link to the City of Pueblo's website which takes you directly to the Pueblo Police Department's annual reports. The reports range from the years 2002 up to and through 2016. However, much of the information you are requesting probably will not be found in any of the annual reports, but please feel free to review them and use any information therein for your research.

There is a $30 per hour initial research fee to obtain information not found online that we must receive prior to conducting any research and releasing pertinent information. Please make your check or money order out to City of Pueblo and mail to the following address:

No further clarification regarding your information request is needed. The number of officer shootings the PPD has had for the past ten years (2016-2007) will be e-mailed to you today, per your request, as well as the number of accidental firearm discharges. However, please be advised that not all information you requested is public information, per Colorado state law - C.R.S.24-72-202(4.5), PPD policy, and Freedom of Information Act, section (b) (2). This refers to detailed information regarding disciplinary action (i.e. whether an officer has received a Letter of Warning, Reprimand, Suspension, or Termination) taken against officers who have violated policy which is not public record according to the aforementioned policies.

Also, please note that this department does not track shootings involving animals. If an officer was found to have violated policy for an improper shooting of an animal, we would have a disciplinary record on file - however, we have no such records on file documenting this.

For statistical data regarding animal shootings by officers, you may wish to contact Pueblo Animal Services at 719-544-3005. You may also wish to contact the Division of Wildlife at 719-561-5300 to see if they may have this data on file. I am writing to follow up on my original request made on 8/17/17.

Thank you very much for providing the information we requested. I am writing to ask for some clarification regarding the data on officer-involved shootings you provided us with. What constitutes an officer-involved shooting in your department? For example, some departments do not count misses while others count all discharges; some include shots at animals. Other departments include intentional and accidental shootings; others do not. Some include all discharges and some exclude missed shots. Please explain to us how your department classifies the OIS included in the numbers you sent to us.

Hello,

When the information was sent to you, only the shots fired during use of force with suspects were counted. To answer your question, officer use of firearms (shots fired) with human suspects is what constitutes officer-involved shootings, which Internal Affairs tracks. I.A. also tracks accidental discharges, but those are not included with officer-involved shootings.

I.A. does not track animal shootings nor do we track misses. For further information or clarification regarding this, you will need to contact Capt. Jeff Bodmer at 719-553-2918.
