To Whom It May Concern:

Pursuant to the Rhode Island Access to Public Records Act, I hereby request the following records:

Use of force data with detail summaries for all use of force incidents from 2008-2016. Please provide the following details for each incident:

Date (year, month, day) of the incident, subject race, officer race, type of force used, whether there was subject injury, and whether there was officer injury.

I prefer csv spreadsheet format (or pdf) where each row represents an incident. Here is an example of the data I'm looking for (https://www.dallasopendata.com/Public-Safety/Police-2015-Response-to-Resistance/594v-2cnd).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Record request #20-628 has been closed. The closure reason supplied was:

Dear Requester,

 

The City has released the requested records that the City maintains.  Please note that the data set released is for 1/2/2011 to 12/30/2016.  The City is unable to provide data for the years 2008 through 2010 in spreadsheet form because the information is not available electronically or in a manner in which each row represents an incident.

 

Please be advised that pursuant to R.I. Gen. Laws § 38-2-3(h), the City is not required to "reorganize, consolidate, or compile data." The City is not obligated to "reorganize, consolidate, or compile data" even if the data is maintained in an electronic format if doing so would unduly burden the City.

 

In this instance, creating a document by reorganizing, consolidating, or compiling data would involve non-electronic records and it would be an undue burden on the City.

 

In accordance with R.I. Gen. Laws § 38-2-8, you may wish to appeal this decision to the Chief Administrative Officer. In this instance, Steven M. Paré, Commissioner of Public Safety, fulfills that role. You may also wish to file a complaint with the Department of the Attorney General or the Rhode Island Superior Court.
