Pursuant to the Rhode Island Access to Public Records Act, I hereby request the following records:

1. the total number of use of force incidents reported by the police department, separated by type of force used from 2020 (for example: 15 taser incidents in 2020, 18 baton incidents in 2020, etc.)
2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained from 2013-2016, and 2020, separated by year (for example: 8 complaints in 2013, 2 complaints sustained in 2013, 4 complaints in 2014, 1 complaint sustained in 2014, etc.)
3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2013-2016, and 2020, separated by year.
4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2013-2016, and 2020, separated by year.
5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2013-2016, and 2020, separated by year.
6. a list of all officer involved shootings that were directed at a person from 2013-2020 (excluding shootings of animals and accidental discharges that are not directed at a person).
7. all information reported to the FBI’s National Use-of-Force Data Collection program to date.

If only partial information is available responsive to one or more of these requests, please provide all of the information that is available.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Requester – 

The City of Providence does not maintain responsive documents pertaining to the following portions of your request: 

·       Prong #7 of your request where you seek “all information reported to the FBI’s National

Use-of-Force Data Collection program to date.” 

 

Please note for Prong #1, where you seek “the total number of use of force incidents reported by the police department, separated by type of force used from 2020” the City has released a partial unredacted responsive document.  See APRA_21-782 Item 1.pdf.  Please note to-date data for this report has only been compiled through August 31, 2021. We recommend resubmitting this portion of your request at the beginning of next year to receive the data for the complete year. 

 

For Prongs #2, 3, 4, 5, the City does not maintain records for the years 2013-2015.  However, for the years 2016 and 2020, the City has released an unredacted responsive document. See, End of Year 2016-APRA and End of Year 2020-APRA. 

 

Please note, the below estimate is being provided for the following portions of your request: 

·       Prong # 6 

·       Prong #2, #3, #4, and #5 (for the years 2013-2015). 

The Public Records Unit has conducted an initial review of the remaining responsive documents and has determined that it will require a significant amount of search, retrieval, review, and/or redaction to respond to your request. More specifically, it is estimated that it will take an additional 3 hours. The Public Records Unit has already expended the free 1 hour.

 

Under the Access to Public Records Act, the City may charge $15 per hour for search, retrieval, review, and redaction, with the first hour free. See R.I. Gen. Laws § 38-2-4(b). Accordingly, you will be charged $45.

Please note that this is just an estimate and you will be charged based upon actual time and costs. Please further note that nothing in this email represents a determination that responsive records will be found or that, if found, responsive records are public records. 

  

Kindly note that the time to respond to your request is tolled pending receipt of your authorization and prepayment in the amount set forth in the estimate. 

 

In accordance with R.I. Gen. Laws § 38-2-8, you may wish to appeal this decision to the Chief Administrative Officer. In this instance, Steven M. Paré, Commissioner of Public Safety, fulfills that role. You may also wish to file a complaint with the Department of the Attorney General or the Rhode Island Superior Court.
