Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Current Employees and or staff roster with names and badge number(s) and or identification number(s), Rank and Annual Salary

Policy or procedures regarding internal investigations of employee misconduct

We are also currently seeking the following for the years January 1st 2017 through the time in which this request is received

Any Officer annual reviews which were conducted

Misconduct or "Civilian Complaints" filled against officers along with any internal Investigations documentation

Civil or Class Action Lawsuits filed against the department

It is requested that this information be released on a rolling basis. Please include any paper copies, digital media, or electronic copies in correlation with requested records.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This message is in response to your Freedom of Information Act request for The State University of New York at Potsdam.

Your request sought:

* "Current employees and/or staff roster with names and badge number(s) and/or identification number(s), rank and annual salary." All such records have been provided.

* "Policy or procedures regarding internal investigations of employee misconduct." All such records have been provided.

* "For the years January 1, 2017 through the time in which this request is received... Any officer annual reviews which were conducted." All such records have been provided. Please note however, that all subjective analysis and/or personal opinions unrelated to future goals have been redacted from the responsive documents, as these constitute an unwarranted invasion of personal privacy under §87(2)(b) and furthermore constitute an opinion concerning performance under §87(2)(g).

* "Misconduct or 'civilian complaints' filed against officers, along with any internal investigations documentation (from 1/1/17 to present)." It is our opinion based on the language of the legislation repealing Civil Rights Law § 50-a and the tenets of statutory construction that the repeal of Civil Rights Law § 50-a applies prospectively only; therefore, any records dated before June 12, 2020 – the effective date of the repeal of section 50-a – are not considered public records available for release under the Freedom of Information Law. The College does not have responsive records in its possession for any disciplinary actions or proceedings, post June 12, 2020.

* "Civil or class action lawsuits filed against the department." No such records exist as described.
