Please find enclosed a check for $30.00 to satisfy the fee associated with the attached public records request.

Thank you.

From: Jacob Appelbaum

I'm following up to add flight logs and other related data for June 7th and June 8th by the same Cessna 172 with registration N739MR. It was again seen flying at an altitude of 2,750 feet and circling downtown Portland. To speed up this request, and to avoid needing to make daily updates, I would like my request to include all data for May 2020, June 2020, and if the request takes longer, for all months until this request is closed. Payment has been sent.

Due to the urgency of the political situation with America regarding public protests across the nation, and specifically with the protests in Portland, I would ask that this request be expedited as it is in the interest of the public at large to have it resolved quickly. Thank you in advance for your time and cooperation in bringing reasonable transparency to these surveillance oriented operations of US persons engaged in political activities.

From: Jacob Appelbaum

Hello,

I am again writing to follow up on my original request from June 5th, 2020. It is my understanding that the time limits for a response have been exceeded and I am eager to receive a response to my request.

Could someone from the Portland Police Bureau provide me with an estimate of production for responsive documents?

Sincerely,
Jacob Appelbaum

Hello,

I think there has been some mistake with the information request system or a mistake in classifying my original request. I have received a reply that states the following:

> The City is prohibited by ORS 181A.820 from using any City "moneys, equipment or personnel" for the purpose of enforcement of federal immigration law.
> You have indicated that this public records request is to enforce federal immigration law. Therefore, the City cannot use its personnel to provide records for that purpose.
>If you have marked this in error on your public records request, please update your request or reply to this message stating "I certify that I AM NOT making this request for the purpose of enforcement of federal immigration laws."

My request is purely about surveillance, and aircraft operated by law enforcement in Portland during the George Floyd demonstrations. I certify that I AM NOT making this request for the purpose of enforcement of federal immigration laws. I am a journalist and the purpose of this request is to publish it for public consumption as part of a wider national project.

My original request was filed on June 5th, 2020 and the expected response is extremely delayed. Could someone from the Portland Police Bureau provide me with an estimate of production for responsive documents?

The City may be the custodian of at least some of the public records you have requested.  The City is preparing an estimate of the time and fees for disclosure of the public records which will be provided by the City within a reasonable time.
It was very nice speaking to you today. This email is to confirm that I received your email concerning the immigration question and that you are NOT using this information for immigration enforcement. I have re-opened your request and will not refund your original payment. As we discussed, I will check with the unit that works with aircraft before contacting our Business Services Group for invoices and other documents. Hopefully, we will be able to get you enough information that we don't need to do that portion. That will save on cost and time. I will work on gathering an estimate for you and respond within 15 working days. Thank you for your patience and I apologize for the confusion. However, you may want to make sure that MuckRock knows there was an issue.

Dear Tammi Weiss,

I'm happy to narrow my request to specifically May 31st, and June 1st. Additionally, I'm happy to narrow the search to the communications (email, call logs, metadata, etc), flight logs, surveillance video, and equipment inventory for the aircraft on those days. I can file a separate request for the historical data.
