From: Penny Allen

Ms. Circelli,
I would like to come in to scan the documents into my device. Considering there are over 2400 documents not in digital format needing to be scanned, I will need a few separate blocks of time and days to complete the task. Do you require me to make appointments or can I come in at my own convenience?
Sincerely,
Penny Allen

From: Port Orchard Police Department

Ms. Allen,

It appears that most of the documents from this second installment are already in digital format, and can be emailed to you or put on a cd and sent to you. The updated payment for this second installment is as follows:

$3.54 (283 emails with attachments at $.05 per 4 files sent via email)
+$28.00 (for 280 photocopy pages at $.10 per page scanned and emailed)
$31.54 = total.
OR
$3.54
+ $42.00 (for 280 photocopy pages at $.15 per page/hard copies) plus postage costs, if any.
$45.54 =total.

We do not have a public computer that would enable you to scan the documents on to your own device.

We have sent the second installment of records in response to this request. We are continuing to process your request and are preparing the next installment. We estimate the next installment of records to be completed in approximately ten (10) business days ,or on or about June 20th, 2018.

From: Penny Allen

Ms. Circelli,
I am writing to you to memorialize what happened when I came in to pick up the records.

I came in today, June 19, 2018 at around 10:00 am to pick up the 280 documents which are not in digital format and are a partial installment to this request for Nathan Lynch's training records. I was told by your staff that I need to pay the $45.54 before I could have them. I shared the following email from you dated May 30, 2018:

From: Port Orchard Police Department
05/31/2018
Subject: RE: Washington Public Records Act Request: Policies and Procedures

Ms. Allen,

We received your payment yesterday. It appears we were delayed in receiving it due to lack of postage.

Cyndi Circelli
Office Manager
Port Orchard Police Department
546 Bay Street
Port Orchard, WA 98366

*That email was your response to my informing you I had sent payment (check #724) in the amount of $45.54 on May 14, 2018 after you had denied having received it.

I was told today that there is a *note from you on the documents instructing to collect $45.54 before turning them over. Upon showing the receipt (email exchange) I was told that because I have requested so many records there was no way to know which request my $45.54 payment was for and I would have to come back at a time you are there. I am not aware of another open request where payment is requested and these documents should be the only hard copy documents your office has for me. This was inconvenient for me as I work the same hours as your office is open and I had to make special arrangements, taking time from my work to come in at a time when your office is open only to be denied the records which I had already paid for.

I will make arrangements to come in again and get them. In the event I need to have someone else get them for me, what will you or your staff need from us in order to turn them over? Time is of the essence as this is a matter of public importance. I look forward to receiving your response upon your return tomorrow.

Sincerely,
P. Allen

From: Penny Allen

Ms. Circelli,
I appreciate your reaching out to me and apologizing about the records not being provided when I came in. I will arrange another visit to get them as soon as I can.

Meanwhile, you indicated you submitted 280 files electronically. I am in receipt of 253. Do you have a list I can use to check off what which ones were received or how would you like to proceed?

Cordially,
P. Allen

From: Port Orchard Police Department

Ms. Allen,

I believe I know what happened with the missing attachments. On 5/31 I sent you 4 emails with the following number of attachments:

Email 1-56 attachments
Email 2-56 attachments
Email 3-56 attachments
Email 4-65 attachments

It appears you have received all four of those emails with attachments. When I logged in on 6/6 after a long weekend, I realized email #6 with 13 attachments didn't send to you. I sent that right away with the attachments. What I didn't realize was that email #5 with 36 attachments never sent either. Those 36 are attached with this email.
So, with all of these, there should be 282 attachments in the form of emails and the last "attachment" was the letter I sent with the first email (283 attachments all together).

Here is a list of the missing attachments:
