Pursuant to the Pennsylvania Right to Know Act, I hereby request the following records:

Any and all inspection records from the Authority regarding water infrastructure serving Ruskin Hall, located at 120 Ruskin Avenue, Pittsburgh, PA 15213.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Please note that I represent The Pittsburgh Water and Sewer Authority ("PWSA"), and I am responding to your Right-to-Know Request ("Request") submitted on January 8, 2019, in which you requested any and all inspection records from the Authority regarding water infrastructure serving Ruskin Hall, located at 120 Ruskin Avenue, Pittsburgh, PA 15213. Please note that the PWSA has determined that it will need additional time beyond the five (5) business days provided for under the Right-to-Know Law ("RTKL"), 65 P.S. § 67.901, to respond to the items in your Request. Pursuant to the RTKL, 65 P.S. § 67.902, the PWSA has determined that the following circumstances apply to your Request and, therefore, the PWSA requires additional time to respond:

(1) The Request may require redaction of records in accordance with 65 P.S. § 67.706;

(2) A timely response to the request for access cannot be accomplished due to bona fide and specified staffing limitations; and,

(3) A legal review is necessary to determine whether responsive records are subject to access under the RTKL.

Please be advised that the RTKL does not require the PWSA to compile lists, prepare summaries, or create documents that do not exist. See 65 P.S. § 67.705. Subject to the above, and any and all applicable privileges, state and federal law prohibitions, and the exemptions set forth in the RTKL, the PWSA expects to provide a response to your Request in a reasonable time period, not exceeding thirty (30) days from the date hereof. At the present time, the PWSA is unable to provide an estimate of fees that might be due in the event public records which are responsive to your Request will be made available.
