From: Dustin Slaughter

To Whom It May Concern:

Pursuant to Pennsylvania Right to Know Act, I hereby request the following records:

A log/database of all Philadelphia Police Department automated license plate reader (ALPR) reads from 1 January to 14 January 2015.

Please include whether the read resulted in a hit/alarm, whether the hit/alarm was accepted, which hotlist(s) the hit/alarm corresponded to, whether the hit/alarm resulted in a vehicle stop, and whether the stop resulted in a citation, arrest or other action.

Please note that as Askew, 65 A.3d 992 found, and which the Office of Open Records has concurred on numerous occasions with prior requests, the aforementioned items and phrasing thereof must be construed in a request's entire context, and your office should find it sufficiently specific.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Dustin Slaughter

Hello,

Please revise the acknowledgement for RTK request #2015-0073i to reflect that the initial request emailed to police.public_affairs@phila.gov on January 23, 2015 did, in fact, include the standard statewide form. The form is attached here for your reference as it was submitted.

Thank you for your attention and prompt revision of the acknowledgement letter.

From: Jeffrey Cohen

Dear Mr. Slaughter,

I apologize for the mix-up. The Police Department’s Open Records Officer (ORO) received the attached “Request Addendum” from the Public Affairs Office, but not the attached RTK request form. I have corrected this mistake in our records, and I am sending the City’s initial response to your formal RTK request; this request will now be processed under the Right-to-Know Law.

To avoid such confusion in the future, please direct such requests to the agency ORO listed in the City’s Open Records Policy (http://www.phila.gov/privacy/pdfs/FinalCityOpenRecords.pdf) to ensure that we receive and process your full request.

Thank you,

To Whom It May Concern:

I wanted to follow up on the following Freedom of Information request, copied below, and originally submitted on Jan. 23, 2015. Please let me know when I can expect to receive a response, or if further clarification is needed. You had assigned it reference number #2015-0073i.

Thank you for your help.
