Communications with John J. McNesby

Please see the attached Right To Know records request form. I am seeking copies of all communications between employees of the District Attorney's office and John. J. McNesby, president of the Fraternal Order of Police, from Jan. 1, 2014 to the time this request is processed.

I also request that all fees be waived as I am a journalist -- employed by MuckRock and the Boston Globe -- and intend to use any pertinent information I receive as a result of this request to educate the public.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am writing to clarify my April 25 RTK request for copies of communications between the District Attorney's Office and Fraternal Order of Police President John J. McNesby between Jan. 1, 2014 and the date this request is processed.

In your May 27 letter regarding my request you asked for me to specify what I meant by "communications" and which employees of the DAO might be in possession of such communications.

By communications I refer to emails, letters, text messages and other forms of instant messaging.

Please search the communications of District Attorney Seth Williams and any other employees of the DA's office who were involved in investigating and determining whether or not to bring charges against Philadelphia police officers Jeffrey Cujdik, Richard Cujdik, Thomas Tolstoy, and Robert McDonnell Jr.

Ms. Graham-Rubin,

I would like to clarify your rejection of the below-mentioned RTK request. By citing the law enforcement exemption are you saying that emails between Mr. McNesby are currently evidence in a criminal investigation?

Mr. McNesby is not an attorney so the communications cannot be construed as attorney-client privileged information, and Mr. McNesby has not formally been charged with a crime that I am aware of so I would appreciate some clarification.

Thank you so much for your help, but please do let me know so I don't put us all through the hassle of an appeals process or litigation.
