Pursuant to the California Public Records Act, I hereby request the following records:

1) All documents outlining current predictive risk models developed as part of the BrightBytes Early Warning system for all schools in the district (and by grade, if applicable). To clarify, I'm requesting the documents that lay out how the models weigh the 24 indicators the BrightBytes Early Warning system monitors in each school. More information about the BrightBytesEarly Warning system models and indicators can be found here:

2) All district and/or school policies governing how teachers, counselors, administrators, and other school staff should use the early warning system. This should include directives to staff about implementing the proper interventions and monitoring for at-risk students.

3) All published studies, white papers, or other research provided to the district by BrightBytes regarding its products.

4) All guidelines, user manuals, or other informational material provided to the district by BrightBytes regarding its products.

5) All contracts and privacy policies between BrightBytes and the district.

I ask that all fees be waived for this request as I am a journalist (examples of my work can be found at and I intend to use the requested records to publish articles in the public interest and not for any commercial purpose.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Mr. Feathers,

My apologies for the late response to your public records request. For some reason, our office did not receive this notice until now.

The following is information that I have been able to gather thus far regarding your request:

* Val Verde Unified School District does not currently use Bright Bytes Early Warning System. The District only used the survey component for technology usage. There was some review of the additional component about a year or two but they did not move forward
* As a result, there are no directives to any staff on how to make use of early warning data BrightBytes in their processes.
* Regarding the request for any and all contracts, we have none for the Early Warning system. All instructions from BrightBytes regarding their Early Warning system were only provided by links to their website.
* I have attached all emails associated as provided by our Education Services Department.

Please reply all to confirm receipt of this information as responsive to the request or provide further clarification if you have any questions regarding the information submitted.
