Pursuant to the Pennsylvania Right to Know Act, I hereby request the following records:

Monthly electronic listings of all employees of the Pennsylvania Executive Branch from January 1, 2019 to July 31, 2022. Specifically, I am seeking electronic listings of all individuals employed within all state agencies, commissions, and departments for each month from January 1, 2019 to July 31, 2022.

For each month, I’m seeking a spreadsheet, database, or delimited text file(s) — not paper records or a PDF created from data — with the following fields for each employee: full legal name, unique employee identification code, date of birth or age, title, department or agency, race, gender, full-time/part-time status, location, hire date, termination date, civil service status, and gross annual salary. If you cannot produce any of these fields, please let me know and generate only the available variables.

If these data are not available at monthly intervals, please produce the datasets at the most frequent interval possible. For example, if the data is not available monthly, please produce the data at quarterly intervals.

In addition, please include any lookup tables that may be needed to interpret the data. For example, if departments are listed with codes linked to a separate table, I will be happy to join the records myself, rather than require your staff to do so.

I am comfortable working with large data sets and can receive the records in a variety of formats (.dbf, .csv, .mdb, etc).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

On November 15, 2022, the open-records officer of the Governor's Office of Administration (OA) received your written request for information. OA is responding to your requests under the Pennsylvania's Right-To-Know Law (RTKL), Act of February 14, 2008, P.L. 6, as amended, 65 P.S. §§ 67.101-67.3104. Under the RTKL, a written response to your request is due on or before November 22, 2022.

This is an interim response, not a final response, to your request. Under the provisions of 65 P.S. § 67.902(b)(2), you are hereby notified that your request is being reviewed for the reason(s) listed below and OA will require up to an additional 30 days, i.e., until December 22, 2022, in which to respond to your request.

· Compliance with your request may require the redaction of certain information that is not subject to access under RTKL.

· Your request is under legal review to determine whether a requested record is a "public record" for purposes of the RTKL.

· The extent or nature of the request precludes a response within the required time period.

Finally, the estimated or actual total for any fees that may be owed when the record becomes available will be included in our subsequent response. Under the RTKL, a written response to your request was due on or before November 22, 2022. On November 22, 2022, I wrote to you indicating OA required an additional thirty (30) days to provide a response. This is OA’s final response.

You requested:

Specifically,…electronic listings of all individuals employed within all state agencies, commissions, and departments for each month from January 1, 2019 to July 31, 2022…with the following fields for each employee: full legal name, unique employee identification code, date of birth or age, title, department or agency, race, gender, full-time/part-time status, location, hire date, termination date, civil service status, and gross annual salary.

Your request is attached. Your request is granted in part and denied in part. You can access the responsive records through the following link: CWOPA Emps by Quarter 2019-2022.xlsx The spreadsheet has tabs in quarterly intervals containing the public data points you requested for employees under the Governor’s jurisdiction, with the exception of those employees whose information is exempt in whole or in part for security reasons and as set forth in more detail below. This link will only be available for a period of thirty days after December 21, 2022, after which you will no longer have access to the link. In addition, please note, all employee work locations are reflected through the headquarter addresses for the agency.

Your request is denied in part due to several requested items being exempt from disclosure under the RTKL. The portion of your request seeking employees’ date of birth, age, gender, race and middle names are denied pursuant to the Pennsylvania constitutional right to privacy. See Rusty Brown and the Freedom Foundation v. Pennsylvania Office of Administration, OOR Dkt. No.: AP 2021-1707 (finding that birth years and middle names were exempt from disclosure pursuant to the Pennsylvania constitutional right to privacy).

In addition, several employees’ information is exempt, either in whole or in part, from disclosure due to the following exemptions:

Section 708(b)(1)(ii), which exempts disclosure if disclosing the information “would be reasonably likely to result in a substantial and demonstrable risk of physical harm to or the personal security of an individual.” 65 P.S. § 67.708(b)(1)(ii);

Section 708(b)(2), which exempts disclosure if disclosure of the information jeopardizes or threatens public safety or preparedness or public protection activity and the information is maintained in connection with the military, homeland security, national defense, law enforcement or other public safety activity. 65 P.S. § 67.708(b)(2);

Section 708(b)(3), which exempts disclosure if disclosure of the information “creates a reasonable likelihood of endangering the safety or the physical security of a building, public utility resources, infrastructure, facility or information storage system….” 65 P.S. § 67.708(b)(3); and

Section 708(b)(6)(iii), which exempts from disclosure “the name or other identifying information relating to an individual performing an undercover or covert law enforcement activity.” 65 P.S. § 67.708(b)(6)(iii).

You have a right to appeal the denial of access to records. Any appeal to this response must be made in writing to the Office of Open Records (OOR), 333 Market Street, 16th Floor, Harrisburg, PA 17101-2234. If you choose to file an appeal, you must do so within 15 business days of the mailing date of this response and send to the OOR:

Hi Wha,

Thank you for sending these along! I have one quick follow up question. Is the "Hire Date" variable the date in which someone was originally hired by the state or is it the date someone was hired for their current position? If it is the former, does it change if someone leaves the state and then returns at a later date?

Mr. Goehring,
The "Hire Date" is not a variable date and is the date in which a person originally began employment with the Commonwealth. Even if there is a break in employment, the "Hire Date" remains the same. Please note, that for a small number of employees the "Hire Date" does not contain a value so the current date of service was used as the "Hire Date".
