Pursuant to the Pennsylvania Right to Know Act, I hereby request the following records:

• The current procedure for procuring personal protective equipment (PPE) on behalf of agencies and entities within the jurisdiction of this office. If this office manages PPE requests for county, local, or private entities, please also provide any guiding material for soliciting, receiving, organizing, and fulfilling those requests.

• Any bids placed by this agency for the acquisition of PPE for this office or on behalf of any entity within the jurisdiction of this agency.

• Any available spreadsheet or aggregate information related to bids for PPE. Please provide all available segregable data, including but not limited to the source, the quantity, and the success of the bid.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In an effort to prevent the spread of COVID-19 and pursuant to the orders issued by the Governor and the Secretary of Health, the Department of General Services continues to remain closed. The days our offices are closed will not be considered "business days" or "calendar days" for purposes of calculating due dates pursuant to the Right to Know Law. We will respond to all Right to Know Law matters as promptly as possible once our offices have been reopened.

Please see the attached response from the Pennsylvania Emergency Management Agency (PEMA), which was sent on June 5, 2020.

In our response, we indicated that although we did not have the records you sought, we would be forwarding your request to the Pennsylvania Department of General Services and to the Pennsylvania Department of Health, since those agencies may have records responsive to your request. However, we also noted that you will need to make a request directly to each of the aforementioned agencies that is 1) in writing; 2) states that it is being made pursuant to the RTKL; and, 3) is addressed to the Agency Open Records Officer of that agency . . .”

Pursuant to the Pennsylvania Right-to-Know Law (“RTKL”), your request to the Pennsylvania Emergency Management Agency (“PEMA”) (Request #2020-0021) closed on June 5, 2020, following PEMA’s final response to you on that date. In PEMA’s final response, PEMA referred you to two other Commonwealth of Pennsylvania (“Commonwealth”) agencies: the Pennsylvania Department of General Services and the Pennsylvania Department of Health. However, as the requestor, you must proactively make new requests to those two Commonwealth agencies as laid out in PEMA’s final response to you. PEMA provided that final response on June 5, June 22, and we attach it here. Again, pursuant to the RTKL, you must make an RTKL request directly to each one of those agencies.
