Good morning Mr. Swire,

Pearland ISD received your Request for Public Information dated February 17, 2023 via email on February 17, 2023 @ 9:54 p.m. We emailed you a Request for Clarification on February 24, 2023 @ 3:52 p.m. but had not received a response. Today, March 28, 2023, we received a letter from you dated March 20, 2023 requesting a follow up to the request. I have pasted the contents of both communications below. I also left a voicemail message for you today at the number provided on your initial request.

Good afternoon:

Please accept this letter as a request for clarification with respect to your request for public information received on February 20, 2023, requesting data regarding any and all complaints, directives, or other guiding material related to section 504 of the Rehabilitation Act for 2019 AND any and all complaints, directives, or other guiding material related to the Americans with Disabilities Act for 2019.

More specifically, the request is overly broad and therefore, we are requesting a certain time frame for the information requested to limit the volume. Further, we request clarification as what specifically you mean by guiding material and directives.

Please be advised that under the Texas Government Code section 552.222(b), this request is being made because the information requested is unclear to the governmental body. As a result, we are asking you to clarify the request.

Also, please be advised that in accordance with section 552.222 (d) of the Texas Government Code, if by the 61st day after the date a governmental body sends a written request for clarification or discussion under Subsection (b) the governmental body, officer for public information, or agent, as applicable, does not receive a written response from the requestor, the underlying request for public information is considered to have been withdrawn by the requestor. Therefore, it is imperative that a response be given before the 61st day of receipt of this request for clarification. Failure to do so will result in the request being considered withdrawn as applicable under law.
