Pursuant to the Oregon Public Records Law, I hereby request the following documents:
All records, including but not limited to communications — e.g., emails — concerning the software known as "Digital Stakeout" and/or "DigitalStakeout."
DigitalStakeout is a company that specializes in "digital risk intelligence," according to its website (digitalstakeout.com). DigitalStakeout offers a software platform (also called "DigitalStakeout") used by law enforcement agencies, as well as private sector entities, to monitor social media posts.
According to a Tor Claim Notice signed by one "Erious Johnson" on April 2, 2016, Mr. Johnson — identified as the Civil Rights Director for the Oregon Attorney General — was interviewed on Oct. 7, 2015, concerning his Twitter feed at the Oregon Attorney General's office ("AG"). Reportedly present at the meeting was Attorney General Ellen Rosenblum, Deputy AG Fred Boss, and Legislative Director Aaron Knott. Mr. Johnson was informed that his Twitter account ("@EriousEsq") had been monitored by an investigator with the Oregon Department of Justice's Criminal Justice Division (CJD). Specifically, Mr. Johnson's account was included in a "threat assessment" conducted by CJD using the DigitalStakeout platform because of his use of the hashtag "#blacklivesmatter." (If the Office of the Attorney General wants to claim it needs access to this document and does not already have it, a copy will be provided upon request.)
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The e-mail with the link will contain various disclaimers: those are automatically generated by the software, and you can disregard them.
The records we're producing are related to the investigation DOJ conducted into Digital Stakeout. There is a pending lawsuit against DOJ related to Digital Stakeout: we are withholding those documents under the public records exemptions for records pertaining to potential litigation, ORS 192.501<https://www.oregonlaws.org/ors/192.501>(1), and/or for attorney-client confidential communications.
