From: Todd Feathers

To Whom It May Concern:

Pursuant to the Oregon Public Records Law, I hereby request the following records:

1) All contracts, including statements of work and/or scope of services documents, between the department and Optumas.

2) Documentation of any algorithms—such as actuarial algorithms, predictive algorithms, machine learning algorithms, etc.—designed for the department by Optumas. This should include project plan/overview documents, final implementation reports, validation studies, disparate impact studies, list(s) of variables fed into the algorithms (including how those variables are weighted, if available), and descriptions of any statistical or machine learning techniques employed.

I ask that all fees be waived as I am a journalist and intend to use the requested records to publish articles in the public interest. In the event you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employee involved and an explanation justifying the employee hours required to fulfill the request.

Should you choose to reject this request or redact portions of it, I ask that you provide a detailed breakdown of the statutory exemptions and associated case law underlying your decision to withhold each/any portions from public review.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

Sincerely,

Todd Feathers

Re: Public Records Request - Optumas Contracts (2022-0201)

Dear Mr. Feathers,

This will confirm Oregon Health Authority has received your February 11, 2022 public records request for:

1. All contracts, including statements of work and/or scope of services documents, between the department and Optumas; and

1. Documentation of any algorithms-such as actuarial algorithms, predictive algorithms, machine learning algorithms, etc.-designed for the department by Optumas. This should include project plan/overview documents, final implementation reports, validation studies, disparate impact studies, list(s) of variables fed into the algorithms (including how those variables are weighted, if available), and descriptions of any statistical or machine learning techniques employed.

Please be aware that we have on several occasions advised MuckRock News that a public record requests needs to be submitted to OHA.PublicRecords@state.or.us<mailto:OHA.PublicRecords@state.or.us>. It is not deemed received by the agency until it is received at this email address. By submitting it to individual employees of the agency delays a response. Again, ALL PUBLIC RECORDS REQUESTS NEED TO BE SUBMITTED TO OHA.PUBLICRECORDS@STATE.OR.US<mailto:OHA.PUBLICRECORDS@STATE.OR.US>.

We will let you know the estimate of cost, if any, before proceeding with your request. Please be aware that due to the size of the agency and the volume of records requests received, the agency completes most requests within fifteen (15) business days. Requests that are expected to go beyond fifteen (15) business days will receive an estimated timeline and periodic updates on the status of the request. We will, however, keep you apprised of the status. Thank you for your patience in this regard.

Re: Public Records Request - Optumas Contract 158015 and Algorithms (2022-0201)

Dear Mr. Feathers,

You have requested records related to Optumas contract number 158015, specifically:

1. The contract, including statements of work and/or scope of services documents; and

Attached is the contract with 31 work orders. There are two pending amendments to WO20 and WO 23, which only extends the time of each of these work orders to December 31, 2022.

As to the second part of your request, the Actuarial Services Unit suggest that you provide what rate development years you are seeking. They will then be able to point you to the certifications that are posted to this website: https://www.oregon.gov/oha/HPA/ANALYTICS/Pages/OHP-Rates.aspx. It will then be able to package up the deliverables for the rate years you are seeking. However, please be aware that there is no limit on years, the unit will need more time and more specifics; after which, if there is a cost involved, we will provide that to you.
