You are receiving this correspondence as a request under the Public Records Law, Nebraska Statutes §84-712 et seq. I am requesting the following:

All records relating to the arrest of Peter Lawrence Citron (November 4, 1939 – June 28, 2003). Requested records include but are not limited to arrest reports, witness statements, and criminal complaints. Mr. Citron was arrested by the Omaha Police Department on February 22, 1990, on suspicion of child sexual assault. He pleaded no-contest to related charges in the Douglas County District Court on May 15, 1990 and was sentenced on July 23, 1990. There is no expectation of a violation of Mr. Citron’s privacy as he passed away on June 28, 2003. A copy of an obituary published in The Omaha World-Herald on June 28, 2003 is attached as verification.

I am a member of the news media, and I am asking you waive any fees associated with this request. I have previously written for PhillyVoice and Atlas Obscura. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling this request within 4 working days of receipt, as per 84-712 (4). I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This request is not being made for commercial purposes. All documents will be provided to the general public without charge.

I look forward to your response within 4 working days. If access to the records I am requesting will take longer, please contact me with information about when I might expect copies or the ability to inspect the requested records.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

police.cityofomaha.org (mailto:police.cityofomaha.org) Dear Mr. Skvarla, I am responding to your request on behalf of the Omaha Police Department.  In your request dated May 18, 2021, you sought a copy of the police report(s) from a sexual assault investigation that occurred on or about February 22, 1990, involving Peter Lawrence Citron.  You stated Mr Citron is deceased as of 2003, therefore, there is no expectation of  privacy.   Your request is made pursuant to the provisions of the Nebraska Public Records Act. This is the response required by NEB. REV. STAT. § 84-712(4) The report number for that incident is E11543.  Incident Reports from the time period you requested have been put on MicroFisch.  Our Data Review Section has searched all files and is unable to find the Incident Report associated with this case.  The detective's investigative reports are on file, therefore it is possible an Incident Report was not completed or it has been misfiled.  The detective's supplementary reports are considered investigative in nature and is not considered public record under Neb. Rev. Stat. § 84-712(5). Therefore, your request is denied. Section 84-712.03 of the Nebraska Revised Statutes may grant you the right to administrative or judicial review of this response. Please consult the statute for further information. Chief of Police Todd Schmaderer is the public employee responsible for the decision to deny a portion of your request.
