Your request is made pursuant to the provisions of the Nebraska Public Records Act. In your request dated August 4, 2021, you sought a copy of the homicide case file for Richard Chadek III, who was reported missing March 23, 1986 and found deceased March 31, 1986. This is the response required by NEB. REV. STAT. § 84-712(4). The Omaha Police Department was not the lead investigative agency on this case.  Richard Chadek's remains were found in what was then Douglas County Sheriff's jurisdiction.  You will have to contact them for information on the Incident Report.  The Omaha Police Department did assist with the investigation, thus follow-up investigation (Supplementary) reports were completed.  Those reports are considered investigative in nature and are not considered a public record under Neb. Rev. Stat. § 84-712(4). 84-712(5), therefore, your request for that material is denied. Section 84-712.03 of the Nebraska Revised Statutes may grant you the right to administrative or judicial review of this response.  Please consult the statute for further information.  Chief of Police Todd Schmaderer is the public employee responsible for the decision to deny a portion of your request.
