Dear Records Officer,

Pursuant to the Kansas Open Records Act, I am a journalist requesting the records described below from your law enforcement agency. I have broken the request into two parts for your reference:

Part 1) Stolen Guns

It is our understanding that law enforcement agencies keep detailed records about firearms that were reported stolen in their jurisdictions. This information is often held in an internal crime analysis and research database such as Versadex, which can be queried for specific property.

We are therefore requesting the following for each case of reported firearm theft in your jurisdiction from Jan. 1, 2010 to the present:

-- The serial number, make, model, caliber and type of each firearm that was reported stolen
-- The address of the reported theft
-- The name of the reporting party
-- The police report number and/or incident number for the firearm theft
-- The date the theft was reported
-- Any other columns available

I would appreciate if your agency provided this information in a spreadsheet or list. If a spreadsheet or list cannot be provided, please provide copies of the police reports, incident reports, or offense reports for each case of reported firearm theft during that timeframe.

Part 2) Property and Evidence Guns

It is our understanding that law enforcement agencies maintain detailed records about firearms that were seized, confiscated, recovered, found, turned in, or otherwise came under the custody and control of the department. These guns are processed and booked into Property and Evidence and details about each are entered into a database.

We are therefore requesting a spreadsheet of every such firearm entered from Jan. 1, 2010 to the present. If a spreadsheet is not available, please provide a printout of the data or any other format of records. The data should include at least the following:

-- The serial number, make, model and type of each firearm
-- The date on which the firearm was entered
-- The police report number and/or incident number associated with each firearm
-- The type of crime or incident involving each gun (e.g., homicide, robbery, assault, etc.)
-- Any other columns available

If a spreadsheet is available for either part of this request, we respectfully ask the department to provide the record layout and/or code sheet so that we can ascertain the meaning of column labels, acronyms and abbreviations, and distinguish between firearms reported stolen and those that were seized, confiscated, recovered, found, turned in, booked into property and evidence, or otherwise came under the custody and control of the department. If a spreadsheet is not available, please provide any and all other records that will yield the information we are seeking.

I am a member of the news media, a reporter with The Trace, a 501c3 nonprofit news organization headquartered in New York City. I am making this request using MuckRock’s public records request management service, which we use to file and monitor our public records requests.

We will be making information obtained from this request available to the general public and are not requesting it for commercial purposes.

In the event that there are fees, I would be grateful if you informed me of the total charges before completing my request.

I would prefer the requested information be sent via an e-mail attachment if available, or a mailed CD-ROM if not. You can send any correspondence or records by responding to this email or sending them to my company email: foia@thetrace.org

If you require standard mail, we ask that you send correspondence and any records to our national headquarters at:

The Trace

Thank you in advance for your help with this request. I look forward to receiving your response.

Sincerely,

Brian Freskos

I am the Records Custodian for the Olathe Police Department (OPD). An open records request that you filed with OPD via fax dated June 6, 2017 was forwarded to me for review and recommendation.

The information that you are requesting is quite extensive and it will take some time to determine if our system is capable of easily providing the data that you are requesting. If our system does not easily have the capabilities to provide the information and each report has to be reviewed, I will send you an approximate cost that will be associated to fulfill this request for information.

I will provide you a status update on your request during the week of June 12, 2017. If you have any questions or concerns, please feel free to contact me via email or at 913-971-6517.

Mr. Freskos,

This email is to provide you with a status update on your Open Records Request. I know in my previous email I anticipated that I would be able to provide you with the information that our Crime Analyst was able to pull from our system by the end of business today, but I am experiencing some technical difficulty and I am unable to access the data that our Crime Analyst pulled from the system. I have sent a request to her to place the document in a different location that I am able to access in an effort to provide you with the information. I will forward you the information she was able to pull from our system as soon as that has been completed. Please feel free to contact me at 913-971-6517 if you have any questions or concerns.

Mr. Freskos,

I attempted to send you OPD's response letter to your open records request along with the spreadsheet of the information that we were able to pull from our database, but the email was returned undeliverable due to a size limitation. Therefore, I am attaching OPD's response letter to this email and will forward the spreadsheet on a separate email in an attempt to provide you with both documents. Please contact me at 913-971-6517 if you have any questions or concerns or are unable to open the attachments.

Sincerely,

Karri Barker

Hi Karri,

Just reviewed the data and had a question: Are Recovered guns those that were previously reported stolen?

From: Brian Freskos

Hi Karri,

Just wanted to followup. Are recovered firearms those that were previously stolen? Also, I noticed when I was copying the data that the 2016-Other file seems to be missing some records. The serial numbers continue for several rows but the other cells in the rows in the empty. Would it be possible to add these missing records?

From: Karri Barker

I will check with the crime analyst that pulled the data and get you a response. I am out of the office tomorrow, therefore; I will try to get with her on Monday, August 21, 2017.

Thank-you,
Karri

Brian: I posed your question to our Crime Analyst and this is the response to your request for clarification:

Yes- Recovered means “recovered by OPD and stolen from anywhere” and Stolen means “ Stolen from Olathe”. Therefore; items with a “stolen” status means that these are firearms that were reported to Olathe PD as stolen from somewhere in the city limits of Olathe. Firearms with a “recovered” status could have been firearms that were stolen from Olathe or they could have been firearms that were reported stolen in other jurisdictions that Olathe recovered during some type of police contact in the Olathe city limits. I hope this information answers your questions. Please feel free to contact me if you have any further questions or need further clarification.
Thanks,
Karri
