Dear Mrs. Hicks,

This is an appeal under the Oklahoma Open Records Act.

On July 30, 2014, I requested documents under the Freedom of Information Act. On August 29, I received a response to my request in a letter signed by yourself. I appeal the result of my request. A copy of my FOIA request and the agency determination which is the subject of this appeal is attached for your convenience.

While I thank you for your timely response of many of the requested records, we have found a discrepancy between our own records and your response, which seems to show that your search was not complete.

Specifically, we delivered a letter on June 2, 2014 via Certified Mail. A copy of this letter is available here: https://www.dropbox.com/s/axud9zdz83z2udv/TST%20letter%20to%20OK%20City%206-2-14.pdf and proof of this letter's delivery, signed by Becki Flood on 6-6-14, is available here: http://i.imgur.com/TziRA0s.png

Why was this letter, and any letters related to its processing, not included in the supplied documents?

Furthermore, it strikes us as extremely implausible that the Commission has absolutely no meeting notes or minutes related to our monument request, even as we see — from the documents we did receive — that the issue of our monument has been a primary issue for the agency for some time. Of course, we are more than willing to give you the benefit of the doubt in this situation, we simply would like the documents we have requested, as is our legal right under the Oklahoma Open Records Act.

Please supply all of the originally requested documents at your earliest possible convenience.

Thank you for your consideration of this appeal.

Sincerely,
Rich Jones
