Pursuant to the Oklahoma Open Records Act, I hereby request the following records:

All police records and/or reports pertaining to any incidents that occurred at the Narconon drug and alcohol rehabilitation facilities in Canadian city, Pittsburg County, Oklahoma in the general vicinity of Arrowhead State Park. This facility primarily operates under the business name "Narconon Arrowhead," but is alternately known as Narconon Drug Rehab and/or Narconon Oklahoma. These interconnected business names for this facility are all officially listed as being located the following adjacent addresses:

Arrowhead Drive, Canadian, OK 74425

Please search your records for all of the business names and addressees I have provided above, as well as the generic monikers of “Narconon” and “Narconon Rehab” that have been occasionally used by the press.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest due to the numerous civil lawsuits currently pending against this controversial Scientology-based drug rehab franchise for wrongful deaths, negligence, fraud, etc. Disclosure of the records I am seeking will greatly aid the public's understanding of what is happening at this non-profit organization, and how law enforcement agencies operate when dealing with such a place. Further disclosures will also aid the public interest in regards to validating the widespread media reports mentioning that the Oklahoma State Bureau of Investigation (OSBI) was investigating Narconon Arrowhead following the death of Stacy Dawn Murphy on July 19, 2012. OSBI's investigation was also confirmed by the Pittsburg County Sheriff's Office police records that were released under a similar record request earlier this year. For more information, please see:

Additionally, the requested documents will be made available to the general public, and this request is not being made for commercial purposes.

This e-mail is in response to your request pursuant to the Oklahoma Open Records Act for the following records:

"All police records and/or reports pertaining to any incidents that occurred at the Narconon drug and alcohol rehabilitation facilities in Canadian city, Pittsburg County, Oklahoma in the general vicinity of Arrowhead State Park." Your request also more specifically cited media reports mentioning that the OSBI was investigating Narconon Arrowhead following the death of Stacy Dawn Murphy on July 19, 2012.

Please be advised that pursuant to 74 O.S. §150.5(D), all records relating to any investigation being conducted by the OSBI shall be confidential and shall not be open to the public. Any unauthorized disclosure of any information contained in the confidential files of the OSBI shall be a misdemeanor and shall be deemed a willful neglect of duty and shall be grounds for removal from office. Furthermore, the Oklahoma Supreme Court decision of Hicks v. Thompson, 851 P.2d 1077 states that the confidential nature of such records does not change upon the closing of the case.

Consequently, the OSBI is prohibited by law from providing you the requested records.
