Dear Adanya Lustig -

The Oklahoma State Department of Health has received your request below. In reviewing this request some of the information that you requested falls under the provisions of the Oklahoma Health Care Information System Act at Title 63 of the Oklahoma Statutes, Section 1-115 et seq. To obtain the information that falls under this Act the following fees apply:

310:9-1-3. Fees and charges
(a) The fee for special reports shall be $50.00 per staff hour for creating or generating reports.
(b) The fee for Public Use Data Files shall be as follows:
(1) Most Current Two (2) Years/each:
(A) Participating Hospitals $ 0.00 - 1st copy at no charge
(B) Non-Profit/Research $ 50.00
(C) For Profit/Commercial $7,500.00 full data year or $0.030/rec + $50/hr for custom datasets
(2) Earlier Years/each:
(A) Participating Hospitals $ 0.00 - 1st copy at no charge
(B) Non-Profit/Research $50.00
(C) For Profit/Commercial $3,750.00 full data year or $0.015/rec + $50/hr for custom datasets
(c) The Department will accept cash, checks, or money orders for payment of fees. The check or money order must be made payable to the Oklahoma State Department of Health.

The remaining information that is not covered under the Oklahoma Health Care Information System Act is covered under the Oklahoma Open Records Act at Title 51 of the Oklahoma Statutes, Section 24A.1 et seq. For that information, the following fees apply:

310:2-3-5. Access to agency records pursuant to the Open Records Act
(h) Fees. The following are fees for reproduction of records:
(1) Paper Records
(A) Regular Copy - $0.25 per page
(B) Certified Copy - $1.00 per page
(C) Copy Sent by Fax - $0.35 per page
(D) Copy of Pages Larger than 8-1/2 X 14 - $0.50 per page
(2) Audio Tapes
(A) With Tape Provided - $5.00 per tape
(B) Without Tape Provided - $10.00 per tape
(3) Electronic Records - Requester is required to furnish blank tape(s) if reproduction is not in a printout format, and reimburse the agency for the actual cost of the use of the central processing unit of any computer used to access data stored therein
(A) $50.00 per hour programming time
(B) $50.00 per hour for other computer time
(4) Search Fees - $25.00 per hour

Good Afternoon.

The information that falls under the Health Care Information Systems Act will take approx.. two hours to research at $50.00 as an estimate for a total of $100.00. Once the research begins if any issues arise that might make the process take longer, the staff from Health Care Information Systems would be in contact with you.

The information that falls under the Open Records Act will take approx. 2-3 hours to research, at $25.00 per hour, that would be $50.00 - $75.00. There will most likely be between 50 - 60 pages produced, at $0.25 per page, that cost will be between $12.50 - $15.00.

The total cost range is approx.. $162.50 - $190.00 to produce the information.

Hi Don,

Wow! That's a little more than I anticipated this costing. Maybe we're talking about different documents? I'm just interested in knowing what data the Department of Health tracks regarding maternal mortality, like if marital status is tracked or not, the region they were from, that kind of thing. Of course you can't create a document for me, but if there is an existing data frame that tracks this kind of information, I would like to see it.

Would that still cost the same ballpark figure?

Don is no longer with this agency. We are in a transition of our General Counsel. I've sent out an email requesting
an update. Several are out this week for various reasons. I currently, do not have answers for you after the last email to
you from Don Maisch regarding costs. It could be a bit of time before there are further answers.

My only roll is to track these, assign numbers & close. I'll advise once I have more info.

Thanks for giving me a call!

I'm just interested in knowing what data the Department of Health tracks regarding maternal mortality, like if marital status is tracked or not, the region they were from, that kind of thing. Some other states have sent me a copy of the death certificate if that's the only way that maternal deaths are tracked, other states sent the "case discussion guide" for their maternal mortality case review guide.
