The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

These are my first public records requests and thank you for working with me on them. It is quite enjoyable learning the rules, I'm sorry if this is exhausting to you because I bet you have to write letters like that all day.

"All text messages between Frank LaRose and Carol Lawler, Frank LaRose and Marian Coffey, and Frank LaRose and Heather McDermotton on any device, government provided or personal, from November 1st, 2019 to November 30th, 2019 on the subject of PEO issues during the 2019 November general election."

Hello Mr. Elippert,

Same questions as last time we talked about text messaging:

Do they not maintain records on this because:

A. Frank LaRosa has no government provided or personal cell phone.
B. He has a government provided or personal cell phone but does not use text messages for records.
C. He has a government provided or personal cell phone, uses text messages for records, but the department is not recording them.

My entire request was based on knowledge that he uses text messages for things that should be records, so your finding of nothing was interesting to me.

Thank you for following up regarding your request. As I had stated in my response, I have inquired within our office and determined that our office does maintain any records responsive to your request and therefore we consider our obligations under the Public Records Act to be satisfied. In the interest of transparency, and for your information, employees of our office are the custodians of their own records, such as emails, notes, drafts, telephone messages, or text messages. Our office retention schedule provides that transient correspondence, such as text messages, which serve to convey information of temporary importance, is only retained by the custodian until it is no longer of administrative value.

If you have additional questions regarding how our office maintains records, I am happy to have a telephone conversation.
