Pursuant to the Ohio Open Records Law, I hereby request the following records:

Any and all emails from 2005 to the present day, as well as all files that are attached to those emails, that are responsive to the search term "Rhonda Reda" (without quotation marks).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

On September 10, 2014, you submitted a public records request to the Ohio Department of Education (ODE). Please consider this an acknowledgement of receipt of that request. Specifically, you requested:

"any and all emails from 2005 to the present day, as well as all files that are attached to those emails, that are responsive to the search term "Rhonda Reda."

Please note that ODE does not have employment records for a current or former employee with the name Rhonda Reda, nor is there anyone licensed by ODE with that name.

We find your request to be overly broad because you are requesting that a search be done on the correspondence of the entire agency. Additionally, you have requested all records containing a particular name or words, rather than identifying the actual record. State ex rel. Dillery v. Icsman, 92 Ohio St.3d 312 (2001). Your request lacks the specificity the office needs to identify and locate only responsive records. Furthermore, Ohio law provides that "it is the responsibility of the person who wishes to inspect...records to identify with reasonable clarity the records at issue." State ex rel. Glasgow v. Jones (2008), 119 Ohio St.3d 391 (quoting State ex rel. Morgan v. New Lexington (2006), 112 Ohio St.3d 33. Furthermore, a governmental office has no duty to "seek out and retrieve those records which would contain the information of interest to the requester." State ex rel. Fant v. Tober, No. 63737, 1993 Ohio App. LEXIS 2591 at *4 (8th Dist. Apr. 28, 1991; aff'd 68 Ohio St.3d 117 (1993).
