Pursuant to the Ohio Open Records Law, I hereby request the following records:

All procedures and policies related to the handling of inmate grievances.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for directing me to the appropriate portion of the Ohio Code. Would you mind providing clarification regarding the lack of grievance procedures? According to 5120-9-31, "The department of rehabilitation and correction shall provide inmates with access to an inmate grievance procedure." I would greatly appreciate it if you could point me in the appropriate direction for obtaining the material I am seeking.

Good morning, thank you for your follow up inquiry. The original response to your request represents the complete process by which our agency manages the inmate grievance process. Our agency is governed by statute, executive order, administrative rule and policy. Typically, statute and administrative rule provide framework in which policy is then developed. In DRC, some of our administrative rules are detailed enough to render a separate policy redundant and unnecessary. That is the case with our grievance procedure. Administrative Rule 5120-9-31 represents the entirety of our grievance process. There is no additional information to provide.
