Pursuant to the Ohio Open Records Law, I hereby request the following records:

1. any requests for proposals, proposals submitted by vendors, contracts, budgets or cost allocations for the purchase and/or use of aerial drones, UAs, UAVs, and UASs (hereinafter “drones”);

2. any policies, guidelines, manuals and/or instructions on university use of drones, including on the legal process required (such as a warrant or court order), if any, before operating a drone;

3. any university records concerning this department’s use of drones now or plans to use drones in the future including:

a. the types of investigations or instances in which this university is using or plans to use drones, or how it plans to support, manage or oversee the usage of drones by another university, government agency or office;

b. policies, guidelines, manuals and/or instructions on storage requirements or procedures for video or static images obtained through use of drones, including retention times;

c. the altitude at which drones can or do fly;

d. drones’ ability to carry weapons.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Musgrave,

This is in response to the public records request you submitted on
August 6, 2012. Please note that portions of your request do not
constitute a proper public records request under Ohio law. Ohio's
public records law does not obligate the University to respond to
"discovery-style" requests that would require us to search for "any and
all existing documents" that relate "in any way" to information that may
be of interest to a requestor. See State ex rel. Fant v. Tober, 1993
Ohio App. LEXIS 2591 (1993); State ex rel. Thomas v. The Ohio State
University, 71 Ohio St. 3d 245 (1994); State ex rel, Dillery v. Icsman,
92 Ohio St. 3d 312 (2001); State ex rel. Strothers v. Murphy, 132 Ohio
App. 3d 645 (1999). The statute only requires that we provide access to
existing records that are requested with reasonable specificity. See
State ex rel. Sensel v. Leone, 85 Ohio St.3d 152, 707 N.E.2d 496 (1999);
State, ex rel. Thomas v. The Ohio State University, 71 Ohio St. 3d 245,
246 (1994); and State ex rel. Zauderer v. Joseph, 62 Ohio App.3d 752,
577 N.E.2d 444 (10th Dist. 1989).

Nevertheless, we have made general inquiries to our Purchasing
Department and found that we have no record of any proposals, purchases,
or contracts related to "aerial drones." Therefore, at this time, we
have no records responsive to your request. If you would like to narrow
your request by providing more specifics regarding your request, such as
specific groups or departments involved, or a specific document, we
would be happy to assist you further.
