From: Hal Flak

To Whom It May Concern:

Pursuant to the Ohio Open Records Law, I hereby request the following records:

All W2 forms for the year 2020. Please redact social security numbers and addresses only.

In advisory opinion 92-005 (1992 Op. Att'y Gen. No. 005), a federal income tax form W-2 "prepared and maintained" by an Ohio township [public agency] acting in the capacity of an employer was considered to be a public record.

This request is not over-broad. It is for a specific set of documents in a specific domain for a single tax year.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

Sincerely,

Hal Flak

Hal,

I represent Oakwood City Schools, and am responding to the request for records that you sent on August 17, 2021. The documents that are responsive to your request are contained in the attached .pdf document, Identified as OCS Response to Muckrock Request 117794-12290039 p. 00001 to 00432.

We have redacted employee social security numbers from each of the documents provided pursuant to Ohio Rev. Code 149.43(A)(1)(dd) and employee home addresses because they are kept by Oakwood City Schools solely for administrative convenience and are therefore not "records" of the office. See, e.g., State ex rel. Dispatch Printing Co. v. Johnson, 106 Ohio St.3d 160. 2005-Ohio-4384.

Oakwood City Schools has fully responded to your records request.
